Negotiations between the company that owns WDTN-TV and Time Warner Cable continued shortly before noon Monday, Oct. 6, said one representative of involved parties.

"Still negotiating, we've been negotiating all weekend," said Courtney Guertin, spokeswoman for LIN TV Corp., which owns WDTN Channel 2 in Dayton. "No deal yet."

Asked if progress was being made in the talks, Guertin said, "I would say we're working hard. We want a fair resolution."

A spokeswoman for Time Warner Cable agreed that negotiations were ongoing.

"There have been no changes," said Pamela McDonald of Time Warner. "We continue to negotiate with LIN Television."

She declined to identify which issues are proving most difficult to resolve at the negotiating table.

LIN TV Corp. wants payment from Time Warner for carrying its 15 television stations while Time Warner argues the cable company shouldn't have to pay to carry stations available over-the-air for free.

Time Warner pulled signals of WDTN and other LIN TV-owned stations from local cable offerings after the two sides failed to agree on a new contract Thursday. That leaves most of Time Warner's approximately 300,000 Dayton-region customers without NBC programming through cable.

Amelia Robinson your reporting is not very good. (Maybe it is a stupid editor.) Why did you not tell us if other local TV stations are or are not getting paid by Time-Warner cable? Why is there not the same situation at this time with the Fox, CBS and ABC affiliates? Why is there no comment sought from the government entity that oversees the cable franchise which Time Warner has? [For example, how long will they allow this to go on before they penalize Time-Warner for not settling it?]

I like cable because TV is no longer free and have had satilites. WDTN is slow getting on board so they are NOT worth the effort or my time. Maybe Oprah will buy them out.

I don’t care for any of the local WDTN programming anyway. But a few of my favorite shows (The Office, SNL, and Meet the Press) are all on NBC. I wish TWC could just pick up another NBC affiliate, but it sounds likes that’s prohibited without WDTN’s permission.

So while they try to work this out, I’ll just keep watching these NBC shows on VEOH (a free internet service). It’s free, on-demand, excellent quality. Plus there’s only a few short commercials!

Btw, the rabbit ears I dug out of the basement really look very chic w my new plazma. Atleast now I get HD.

When, and if an agreement is reached, don’t let WDTN fool you in believing they somehow won. TWC has made an offer to Lin TV, but my understanding is that it is an offer which stipulates payments ( if any ) based on the network the local provider represents, the market share owned /ratings of the local provider, and has provisions for +/- payouts based on ratings.

Here in Dayton, with poor ratings and the downward trend of WDTN, and the fact that they are NBC, may mean no pay for WDTN!

Amused gets it, Earl gets it, how about you, do you get it?

Some months back, WDTN implemented a blog / discussion area similar to this where viewers could express their opinions on various stories and etc. The comments were so negative, that they scrapped the format, preferring to paint their own positive only portrait.

WDTN and LIN TV lost 211 million thru June 08 and now want to make for poor managemnt on the backs of TWC subscribers.

When you pay TW for your “free local channels” you are paying a retransmission fee, not for the channels. You are also paying to have those channels transmitted in a clearer form. Get over yourselves. If they cave to WDTN, every other station will be lining up to get their share then watch your cable rates shoot even higher. TW is a business and obviously must watch their bottom line, if they went out of business then what would you do…probably whine some more…get over yourselves.

It is reported that TWC has approximately 300,000 customers in the greater Dayton area. Of that,less than 15% watch WDTN at any one time. WDTN says they want only “pennies a day”, but they want it for all 300,000 subscribers, and that amounts to about 1 Million dollars a year per penny?

WDTN doesn’t even say how many pennies a day they want? Pennies is plural, we know they want at least 2, but could it be 3, or 99. WDTN is playing you for the fool if you really believe theit “cents” argument

We bought a digital converter box and are able to receive WDTN in digital now. The picture is very sharp compared with the old Time Warner station.

My question, is Dish Network or Direct TV planning on carrying locals in HD, in the Dayton area? And if so, when? The only reason that I’m not going with satellite right now is that they don’t offer locals in HD.

For those who don’t understand why all the fuss?

TWC has a contract with all local stations. These contracts are designed to spell out the processes and procedures under which TWC will re-transmit the local stations broadcast. These are not contracts where in fees are negoiated or paid for “rights”

There are however significant costs associated with the re-transmission, and these are the costs you see on your TWC bill. Don’t let WDTN play you for a fool!

WDTN: Time Warner is taking our signal for free, and charging you for it. Me: Time Warner is charging me for a digital cable TV distribution system, not your lousy station. WDTN: Other cable systems and satellite operators pay us, so TWC should, too. Me: TWC doesn’t pay other local stations for their signals, so why should they pay you? Fact: WDTN needs the cable audience more than TWC needs Channel 2. Advice: Get an antenna and wait all this out. Greedy LIN TV will have to cave eventually.

Realist: I look at it this way. You can get WDTN’s signal free with an antenna. I pay TW to be my antenna to pick up WDTN’s free signal. It’s the same as if a farmer were giving away free tomatoes. If I can’t pick them up myself, I pay a neighbor to get them for me. The tomatoes are still free; it’s the delivery that I pay for. Why should the farmer get a share of my delivery fee?

I don’t presume to know the FCC regulations, but I question the statement that they bar TW from carrying an out-of-town network station when there is a local station on the same network. How then is TW able to carry Cincinnati CBS affiliate WKRC as well as Dayton CBS affiliate WHIO. If WDTN chooses to opt out of TW programming, TW then should be allowed to carry WLWT, Cincinnati’s NBC affiliate.

Would people stop it with the “they took my NBC station, they broke contract” routine? Section 4a of your TWC service agreement… “I agree that TWC has the right to add to, modify, or delete any aspect, feature or requirement of the Services (including content, price, equipment and system requirements).” You really think with all the lawyers they probably employ that this situation wouldn’t have been planned for?

I have talked lately with Time Warner (which I am a current subscriber) and Satellite and for the same thing I got a better deal with Time Warner. All you have to do is call and complain every two years lol. As for WDTN I’ll dig out the old fashion Antenna if it isn’t setteled in time for the super bowl.

Lin Corp has not shown me a lot. Who would be willing to go door to door with petitions to the FCC to investigage this whole issue, and, if one or the other or both companies involved have violated the terms under which their franchise was issued. And, if the terms were violated, then issue fines, or if necessary, pull the licenses and reissue to someone who is interested in service to the community. If the community is served, then viewership rises. Rises in viewership attracts revenues.

Hey, I just got an old indoor antenna out of the closet and hooked it up to my HDTV. I now can get WDTN in HD and all the other local HD stations are coming in with a much better picture than I got from cable. Let WDTN and TW bicker all they want. I don’t really care what happens. I’m better off now than I was before TW dropped the signal.

WhoisLaura???, I am telling the truth about my cable, internet, and phone through Time Warner cable being on at the same time that my electricity went back on. I am a real person. I called DP and L within ten minutes of my power going out and within 2 hours I had my power back on after the windstorm. I am just voicing my opinion. Just because you are upset with WDTN 2 being dropped from Time Warner’s channel line-up doesn’t give you the right to keep saying the negative stuff about me.

OMG!!!! We just checked our living room TIVO for Heroes and saw that Airplane was on!!!!! AAAAHHHH have to watch it on the internet now! Guess I will have to get one of those SDTV boxes and break out the rabbit ears! A friend of mine is using one and he loves getting a bunch of free digital quality channels. Food for thought. Also many decent PC’s can be piped into your TV for internet viewing. It’s fairly easy if you are techie inclined and have broadband internet.

I am sure there is blame on both sides for this but Time Warners credibility sure has take a hit since the disasterous implemention (down grade as opposed to upgrade) of the MYSTRO software for the digital program guide. Since July they have said they have a team of technicians working soley on correcting the problems with the new program guide. Either this is a big lie or these technicians are a group of trained monkeys. Even Time Warners field techs admit this has been a disaster.

Now, WDTN was well as all of LIN TV stations are demanding a FEE be paid the station for the “priviledge” of re-transmitting the stations signel..

This is “Blackmail” if you don’t recognize it as such, and if LIN TV is successful, it will cost the TWC customers only, additional money. Over the air consumers won’t pay a cent more. That’s why it makes no sense to most logical consumers. WDTN and LIN TV are out to ripoff the TWC customer.

TWC has a contract with all local stations. These contracts were negoiated to provide a legal platform on which TWC will re-transmit the local stations broadcast. This just helps make sure both parties are functioning in accordance with FCC rules and regulations..

NO MONEY PER SE, IS PAID AS A FEE FOR THE “RIGHTS”. There are however tremendous costs associated with the re-transmission, and these are the costs you see on your bill. OK?

I was visiting friends in Indiana over the weekend, and ironically they’re facing the same thing with their cable system, Brighthouse. WISH TV (the CBS affiliate there) was off the air starting last week. WISH TV is also owned by LIN, the company that owns WDTN.

I don’t understand why A) This wasn’t a problem for every other local station in Dayton and B) How WDTN isn’t breaking a contract with their advertisers.

I prefer news on WHIO-7, but this better be fixed for The Office and SNL!

I liked WDTN and I am enjoying LIN TV replacement for now of HBO Family. I think LIN TV makes plenty of money from commercials & promotions & advertising etc.. LIN TV is being greedy. Deal or No Deal.. The best case scenario is to have WDTV give up on their greedy requests, and get back to the business of running an over the air broadcast station rather than trying to double dip in to the consumers pockets of TWC subscribers, many of whom may not even watch WDTN, of if so, only occassionally!

WDTN is looking for TWC to pay them for the right to advertise to TWC subscribers.. What’s wrong with that picture?

Ed, Time Warner and Lin TV have been negotiating for the last couple of weeks and all weekend because I have been getting daily updates on negotiations either by phone or e-mail. I did speak to Tiffany who works in the office of the president of Time Warner and both sides are still talking. It is NOT Time Warner fault for WDTN being pulled from the channel line up.

Let’s make the argument a different way. Why doesn’t Time Warner only change us for the channels we want (ala-carte). Let the customers select which channels they want to pay for. They have fought that idea for many years. That would resolve this issue completely. They say it would cause some channels to go away. I say if they have no viewers and cannot support themselves; goodbye! Ala-Carte would solve many of these issues. Spread the word!!!!

No..they can’t. Federal regulations bar that from happening when their is a local affiliate. Its the same issue that Fox19 and Fox45 have, when primetime starts, TWC starts showing infomericials on 19, because they aren’t allowed to show the same network programming without a waiver from 45

If you have an HDTV ready TV don’t fret. Get an antenna from BB or Radio shack. Plug antenna into the coaxial jack in back. HDMI is in your TWC box. Go into the TV set up choose antenna. and then scan the available channels. Your HDTV will down load all local HDTV channels (I got 9 HDTV locals) Now I have NBC in High Def. It is free and it came in Great. I watched the Steelers win in HD last night!!!!!

If I advertised on channel 2 I would asking for my money back as they are not reaching the audience they promised by not being on TW. I would also not adverise with them again. I understand they have bills to pay, but they are not going to make it up by not getting out to the viewers who buy the products advertised on their station.

WDTN can do whatever it wants. All I care about is NBC. Certainly Time Warner could use a NBC affilate in Cincinnati or Columbus to replace the local Dayton problem. Especially now when the elections are close and viewers should be able access NBC’s coverage. Doesn’t NBC care if the Dayton Ohio area gets their signal? Couldn’t they step in and let TW know that NBC does care and does spend the money to be viewed everywhere.

I could really care less. I wish that TW was cheaper and carried more HD channels, but they don’t. However, they do offer the fastest internet in my area. I use the net more than cable to begin with, so in the rare occasion there is something on Channel 2 worth watching (Monday Night Football is about all the comes to mind), I just get out the rabbit ears. We didn’t have an NBC HD channel to begin with, so it’s not like I’ve really lost anything.

Bubba, I say shame on Channel 2 because they say they send their signal out free to thier viewers. If they charge for it is no longer free is it. Also, as a TW customer, I chose to pay for progaming. Why should my rates go up due to channel 2 wanting money above and beyond what they get for advertising?

I hate to tell you but Time Warner is the one getting .01 a day for channel 2. The charge subscribers .01 a day while giving channel 2 nothing. Meanwhile Dish, DirecTV and everyone else pays channels 2 to carry them, and they charge consumers less.

As someone else pointed out, TW has done this before with the Big Ten network and will do it again because of their greed.

As of October 8th, DirecTV offeres free HD on all local channels in Dayton. With twice as much channels for the same price and being able to see WDTN all weekend, why would you not want DirecTV? They have a one year contract and is negotiable each year. TW will be gone in the next 5 years since beeming into the sky to get service is 10x cheapper than running cable. See ya TW, thanks DirecTV!!!

I think I am on Time Warners side.. At a penny a day per subscriber per station carried.. For only one station… 300,000 subscribers X .01 = $3000 per day X 365 days = $1,095,000 per year .. Seems just a bit too high .. You would think LIN TV would want the station carried to have a larger advertising base…

I see both sides of this situation, but for those who are sympathetic to Time Warner or feel they are working to keep your costs down ….. I just have to laugh. No offense intended, but that is a joke and it just shows their propaganda on this issue is working. Time Warner has ripped people off around here for years and gave little in return (horrible customer service). Go ahead and take their side, but please don’t for one second believe they are working for you but for more profits!

If you have had the “privilege” of having Time Warner as your cable provider, I’m sure you also have seen the “bill creeping higher” phenomena. They charge too much for the service they provide and are working both ends trying to make a buck. I find it hard to believe that this multi-billion dollar monopoly can’t afford to pay up. May I remind you that this is not the first time this has happened, recall the Big 10 network. I have since rid of them.

At this point I don’t really care who is right and who is wrong. I’ll be selfish and say the only thing I care about is not getting NBC & NBC HD (we are a TV2 news family). Bottom line for me is that as soon as Uverse is available for me TW is history. Don’t care much for contracts so that leaves Dish and DirecTV out. They do not carry local HD anyway through their service which is also a negative. TW might want to sell off the rights to cable in the Dayton area very soon.

I get my NBC programming the way I always have-by watching channel 4 in Columbus, WCMH. Cable companies should not have to pay to carry over-the-air stations and the cost WILL be passed on to subscribers. The FCC has caused 90% of all the problems with the cable industry, including allowing the blocking of some channels at times by others.

I read where people get WDTN in HD with an antenna? What channel provides that? I tune to 2.1 and get no signal. I did a search and got no NBC channel in High Definition. All of you taht say you get WDTN in High Def with an antenna, what channel are you using??

I canceled my cable subscription. Nothin’ but rabbit-ears for me. Absolutely FREE TV!!! I love it. I actually didn’t need all those channels anyway. and I’m saving a ton of money.

We’re about ready to switch. We have channels coming in spanish intermittantly, some channels have background music with no dialouge, and some channels have no sound at all. These problems disappear when watched on a set without a box.If they know this a problem why can’t they admit it when called. Instead they claim to not be aware of it and try to set up a technician to come out and waste my time diagnosing. TWC better get their s**t together before you see a mass service change.

You shouldn’t have to switch…I expect ALL local channels when I pay my exorbatant monthly bill to TWC. That said we switched because the WDTN thing is just the last straw in a never ending bad, not doing as promised service. How can we entice other cable companies to our area?

Aprtment complexs can not prevent you from having satelite but then can prevent you from attaching to thier building. I own a condo and can have satilete, I just can’t attach it to the building, which I would not want to do anyway.

William, I live in Miami Township and I had my cable, internet and phone through Time Warner back on within two hours when we had the windstorm. FYI-I also had my electricity back within two hours had the windstorm because within a mile I have a fire station, the Miami Township Fire and Police Headquarters, and Kettering Medical Center. The only times that I lost my cable service is when we have bad weather and that has been only TWICE.

I love how DDN thinks nbc programming is the only thing on there. Are they really this dense? Did they forget Bonnie, 700 club, Oprah, Inside Edition and Jeopardy are syndicated? DUH!

Anyhow, I have a USB Tv Tuner that runs off the USB with an antenna, and catch Jeopardy. The hell with the other syndie offerings. If I want to watch Oprah, I just tune to her whitey boy Phil on 7 anyhow.

I decided to get an indoor HDTV antenna. I am able to receive both the WDTN and WLWT(Cincy)HD signals over the air. Saw the Steelers/Jag game in HD..nice! Southeast suburb locations should be able to pull in WLWT with south facing antenna.

I never watch channel 2 anyway. But why is it on TWC that both 2 and 3 for me (NBC & CBS) always show up all full of fuzz and static? The picture is terrible on both those stations & always has been, but it’s been worse than ever since the storm. Anyone else have that problem?

Over the years of switching back and forth between cable and sat, I’d have to say I actually see far more outages from cable. Only sat reception issue I had was when it was completely covered with snow..and you can fix that by yourself in a few seconds. In the end, TW’s signal is sat too anyway.

For apartments, it’s outright illegal for them to prevent you from installing a dish. No matter what the leasing contract says, this fcc rule overrides it. http://www.fcc.gov/mb/facts/otard.html

I’m tired of the people who say just hook an antenna. First, I pay for a HD DVR to allow me to time shift my programs and hate watching live TV. Second, my TV doesn’t have a built in HD tuner so I would have to buy an expensive HD receiver. TW charges us for the basic tier, which is just local channels so they should receive some of that money.

I bought a digital antenna at MCM Electronics - antenna, special mount, wire, taxes was ~100.00. I now get 30 digital and 20 analog stations with it - including all 3 from WDTN. And it is clearer than cable. I am now starting to look at satellite …

The following is an email I got from WDTN, it clearly shows a low they will go to get thier whinning a— way. I think it is uncalled for and unetical to stoop to the following.

Time Warner’s contract to carry WDTN TV 2 expires Oct 2nd, yet Time Warner will not negotiate a new contract.

By Federal Law, Time Warner must drop WDTN TV 2 on Oct 2nd if they do not have a contract to carry our station.

HELP US KEEP WDTN-TV ON TIME WARNER BY CALLING THEM AT 513-489-5000!

gaga: WDTN has been broadcasting digitally for a number of years now. To some, a world outside the realm of what Time Warner offers simply doesn’t exist. To be clear, it’s Time Warner who hasn’t had WDTN’s digital (HD) channel.

RASBERRY, you can’t get another NBC because of WDTN, they do not want other nbc affilites in “thier” market. I can get the cicinnati stations and don’t miss WDTN at all. We are not missing out on anything by not having them.

…TW had a booth at the Oktoberfest over the weekend and talked freely about the ongoing negotiations. What is not being said publically is TW does not compensate the other local channels. TW does compensate WHIO for its weather channel.

continued.. When I insisted that they give me the $100 credit , they refused. I prompltly cancelled and went to Direct TV. Now I’m back to cable because I can’t have a dish at my apt complex and I hate it. Time Warner Customer no service has the rudest reps I’ve ever talked to. I wish there was another cable provider in this area, because I would switch right now.

I will be watching Heroes online tomorrow here: http://www.nbc.com/Video/ Thank God for the Internet. Time Warner is the worst TV provider in this area. If I didn’t live in an apt. complex, I’d still have Direct TV. I switched from Dish to Time Warner because they said they would give me a $100 rebate for my Dish equiptment since I owned the receivers. Guess What? I never got it because the installer forgot to give me the rebate form( which they never told me I needed to get from him). Ripoff

Listen everyone. Just stop complaining, if your not part of the solution you are part of the problem. So your problem is your upset about not having 2. So be part of the solution and switch to Dish and stt for interent. I tell you what I was hesitant at first but once I saw my new service and how fast my new internet was I am totally happy. I will never go back to TW. I have DSL now through Att and its way faster than the road runner I had with TW. If you dont believe me try it out for yourself.

WDTN offers nothing new to the community. they have made no attempt to go HD like channels 22, 7 & PBS. the shows on NBC basically offer nothing. the other networks have the best programing. Sooo……..TW hold out and let channel 2 fade into the abyss

ours is not the only city or cable system to deal with this issue, just so you know. but we’re getting our NBC through the big old antenna on our roof…a $7 piece converts the two-wire antenna line to coaxial cable which goes in one of the input plugs on the HDTV…makes it look waaaaay better than the old channel 9 from the cable box! we may never go back!

I’m sticking with TW myself and I’m sure they will settle soon. My brother had the dish and didn’t like it. They lost signal during rainy days and bad weather. They switched back to TW and are much happier. I only watched a few shows on NBC and I prefer the news on WHIO. So, no big loss to me and if something I really want to see I just go to NBC.Com. You people that moan and complain make me laugh. Oh well, people are people.

Personally I enjoy getting HBO family in place of Ch. 2. It’s just like the incentive that Ch. 2 is offering people to switch from cable to satellite! Time Warner, don’t fall prey to Ch. 2’s corporate greed! LIN TV is losing money all over the US, they just want to make up for it. Don’t let WDTN raise our cable rates! Keep ‘em off the air and thanks for HBO Family!

Your credibility goes pretty low if you try and make a point that way, don’t you think? Fact is, wind does NOT affect satellite reception in any way whatsoever! If someone was losing signal during the windstorm, their dish wasn’t securely mounted.

And “for the record”, I work for neither Dish nor DirecTV. “For the record”, I get WDTN-DT via an antenna (for FREE).
