Stiletto-heel attack leads to prison sentence for Dayton woman who blinded Good Samaritan
DAYTON - A woman convicted of attacking a Good Samaritan with a stiletto-heeled shoe, leaving him blind in one eye, was sentenced to 18 months in prison, the maximum amount for her conviction.
Heather Sims, 28, of Dayton, was indicted April 20 on one count of felonious assault, a second-degree felony punishable by up to 8 years in prison. She pleaded guilty June 3 to one count of aggravated assault, a fourth-degree felony punishable by up to 18 months in prison.
The 18-month sentence was part of Sims’ plea agreement with prosecutors, who did not ask for any restitution payments, as Anthony Miliner’s medical treatment was paid for by his insurance company.
Speaking to Montgomery County Common Pleas Judge Timothy N. O’Connell, Sims apologized to Miliner and said that it bothered her to learn that Miliner’s children looked at him differently when he was forced to wear an eye patch.
Using their cellular phones, witnesses recorded the June 27, 2010 attack at the McDonald’s on Free Pike.
Miliner and his brother were in the drive-thru line when they saw a man in the car ahead of them beat his female passenger and shove her from the car. Miliner and his brother went to assist the woman, police said.
A Chevy Suburban pulled up next to them and four to five women got out, accusing Miliner of hurting the woman. They crowded around the truck Miliner and his brother had retreated to and attacked, police said.
Sims struck Miliner, now 36, in the face with her shoe, hitting him in the eye, as the other women hit and spit through the passenger window of a truck he was sitting in, police said.
Sims had eluded capture for 10 months before surrendering to police in April. She has remained in the Montgomery County Jail since.
