NBA legend busted for drunk driving

It didn’t happen in Dayton, but since I love Sir Charles, I had to mention this:

Former NBA star and Hall of Fame forward Charles Barkley was arrested on suspicion of drunk driving by Arizona police early Wednesday morning, Dec. 31, in his 2005 Infiniti.

Barkley, 45, evidently blew through a stop sign and then failed a field sobriety test given by a Gilbert police officer. Blood was also drawn to determine his blood-alcohol content, according to reports.

He was issued a citation and released, avoiding a trip to jail somehow. Barkley, now a commentator for TNT’s NBA programs, has several prior arrests including aggravated battery in 1997 and for assault in 1991.

And this past year he was sued by a Las Vegas casino for not paying a large gambling debt. He then declared he was done gambling on TNT and then a short-time later played in a poker tournament “for charity.”

I still love him, though. I play poker “for charity” all the time, as well.

Drug detectives fish crack out of sewage pipe

DAYTON - A 27-year-old man is in jail after narcotics detectives fished crack cocaine out of sewage pipe inside a house they believe is used to sell drugs.

Police knocked on the front door of 213 Pierce St. at about 7:30 p.m. on Monday, Dec. 29, and noticed Jajuan Faulkner walk into the dining room and grab a piece of crack off a dining room table, according to a police report.

Faulkner then made his way toward the door, but suddenly stopped just two steps from it, the report stated. He then turned around, ran upstairs and tried to flush the crack, along with items from a digital scale, down the toilet, the report stated.

As he was doing that a woman came to the door and asked detectives why they were there, the report stated. Once inside, detectives noticed a piece of crack on the dining room table.

Upstairs they found the bathroom drain clogged and batteries floating in the toilet, the report stated.

One of the detectives then went to the basement, unscrewed a portion of the PVC sewage pipe and used a coat hanger to fish out the crack that Faulkner flushed, the report stated.

Police also found a 9mm handgun, a digital scale and marijuana in the house.

While handcuffed inside a police cruiser Faulkner admitted he flushed the crack earlier, the report stated.

The woman told detectives that Faulkner was selling drugs to “pay for his brother’s funeral,” the report stated.

Faulkner is in jail on felony charges of drug possession, tampering with evidence, receiving stolen property, having weapons while under disability and possession of criminal tools.

A background check found he has numerous felony convictions including drug trafficking in 1999 and July of 2008 and for burglary in 2002.

Authorities raid meth lab in Harrison Twp.

HARRISON TWP., Montgomery County - Three people were arrested Tuesday, Dec. 30, after sheriff’s deputies raided what they are calling “one of the most elaborate meth labs” they’ve seen.

Deputies entered the house at 2241 Coronette Ave. just after noon and found a meth lab, surveillance equipment and thousands of dollars inside, Sheriff Phil Plummer said.

“It’s one of the largest operations we’ve seen here in some time,” Plummer said. “We believe they were also selling it out of the place.”

Deputies are still searching the house as of 1 p.m. The names of those arrested were not yet available, Plummer said.

Armed teen tells police he found marijuana at store

DAYTON - An 18-year-old man was arrested Monday, Dec. 29, after police found him sitting on a handgun and marijuana that he said he found at a local Walgreens.

Officer Ryan T. Halburnt was on routine patrol at about 10 p.m. near the Walgreens pharmacy at 2710 Salem Ave. when he noticed Rashied J. Gabriel Jr. and three other juveniles inside a silver Kia parked in the rear of the lot, the report stated.

The teens did not get out of the car so Halburnt drove by. As he approached, the car’s driver, 17, got out and started to reach into his pocket, the report stated.

Halburnt said he then noticed a strong odor of marijuana coming from the car, the report stated. The juvenile driver kept reaching in his pants pocket, so officers patted him down and found a loaded revolver, the report stated.

Inside the car, officers found Gabriel sitting on a loaded handgun and a “fist-size” amount of marijuana in a baggie at his feet, the report stated. They also found ecstasy pills in his pocket.

Gabriel told officers he found that marijuana in the parking lot and thought “it was his lucky day,” the report stated.

Gabriel and the juvenile told officers they carry the guns for protection, the report stated. He faces felony charges of carrying a concealed weapon and drug possession, according to a police report.

The other two juveniles in the car, ages 16 and 17, were not charged with a crime and released. The 17-year-old driver was transported to juvenile detention on weapon and drug possession charges, the report stated.

Higgins Station shooter faces life in prison

DAYTON - The gunman who killed a man inside Higgins Station bar was indicted by a grand jury Monday, Dec. 29, on 18 felony counts, including murder and 12 counts of felonious assault.

Rodney T. Young, 29, faces life in prison, plus another 130 years if convicted for what police called the deliberate murder of David Watson, 21, Montgomery County Prosecutor Mathias Heck Jr. said.

Young also shot and wounded five others inside the bar, but those victims survived.

Trotwood detectives believe Young targeted Watson when he walked into the bar on 420 E. Main St. on Dec. 12 and started firing. Young had earlier been thrown out of the bar, according to police.

Young, 18 Oakley Place, was arrested days later when U.S. marshals and local authorities kicked in the door of a Fort Mitchell, Ky., motel.

He also faces felony charges that include two counts of having weapons while under disability, one count of carrying a concealed weapon, illegal possession of a firearm and intimidation of a witness.

Young also violated his parole stemming from a 1998 bank robbery. Authorities said Young was placed on supervised parole in September after serving part of a 12- to 14-year federal sentence for the armed bank robbery.

Brothers arrested in drive-by shooting at DeSoto Bass

DAYTON - Homicide detectives have arrested two brothers believed to be responsible for a drive-by shooting that left a man in critical condition, Monday, Dec. 29.

Tuvon Dudley, 19, of 1221 Superior Ave., and his 16-year-old brother were arrested at about 5 a.m. on felonious assault charges, Sgt. Gary White said. Police are not releasing the identity of the juvenile until charges are formally approved by the Montgomery County Prosecutor’s office.

Police are also not releasing the victim’s name or age for his protection, but he was shot once in the chest just after midnight Monday while inside a DeSoto Bass apartment at 72 Bragg Place, White said.

Residents at the complex said a group of people were partying in and outside of the apartment when an argument broke out at about 11:40 p.m. Dudley and his brother were then allegedly told to leave, White said.

The brothers then drove back to the apartment 30 minutes later and fired 15 rounds from about 10 yards away as they drove by, White said. Numerous bullet holes can be seen around the window and front door of the apartment.

“Officers were in the area and heard the shots,” White said. “We were able to make arrests after multiple interviews with witnesses.”

White said it’s undetermined if the shooting was gang-related, but said the two brothers have been involved in gang-related activity prior to Monday’s shooting.

“We are not sure why they were asked to leave,” White said. “We are fearful there could be some retaliatory shootings because of this so we are still investigating to see if anyone else was involved in the incident.”

A background check found Duvon was arrested in 2005 for receiving stolen property and for sexually assaulting a 14-year-old girl in 2007 when he was 17.

Police: Man drags, punches officer during drug bust

DAYTON - A 31-year-old man suspected of buying heroin from a house at 32 Utah Court is in jail after he dragged and punched a police officer Monday night, Dec. 21.

Benjamin J. Gulley walked out the back door of the house at about 10 p.m. as officers responding to a neighbor complaint about drug activity arrived to check the scene, according to a police report.

Gulley kept walking as Officer Jeffrey Downing was questioning what he was doing in the house. Gulley said he could not provide an identification, according to a police report.

As Downing questioned Gulley, a blue pickup truck pulled up with two white males inside. Gulley said it was “my ride” and he had identification inside the truck, the report stated.

Downing became suspicious as Gulley fumbled with items inside the truck and started reaching for things, the report stated. Then Gulley began to walk away from the truck.

As Downing escorted Gulley back to his cruiser in order to obtain some identification, Gulley took off running with Downing still clutching his jacket, the report stated.

Gulley dragged the officer as he tried to run away, then turned around and swung at Downing, hitting him in the shoulder, the report stated. Gulley then tried to get out of his jacket, when another officer arrived to help Downing subdue the suspect, the report stated.

Gulley kept swinging at the officers, so the officers started swinging back in order to subdue him, the report stated.

Once in handcuffs, police found heroin and marijuana in Gulley’s pockets, the report stated.

“I was getting it for a friend,” Gulley said. “I know it was stupid, but I was getting it for a friend.”

Gulley also said the two men in the truck were coming to pick him up because they wanted heroin, the report stated.

Those men were not charged, but Gulley was arrested on felony charges of assault of a police officer and drug possession, the report stated. He was also charged with resisting arrest.

Man in critical condition after walking into traffic

DAYTON - A man is still in critical condition after he intentionally stepped out in front of a car on North Main Street Monday night, Dec. 22, according to police.

Robert Brisco, 45, is fighting for his life at Miami Valley Hospital after he suffered significant head injuries when he was struck by an SUV in the 3300 block of North Main Street, according to police.

Brisco was walking southbound on North Main Street at about 9 p.m. when he suddenly walked into the path of the vehicle. The driver of the SUV was not injured and is not being charged in the accident, according to police.

Three men, including one officer, tased during struggle

DAYTON — Two disorderly suspects were tased by officers — one of which accidentally discharged the weapon onto his own hand — who responded to a call regarding possible alcohol poisoning that turned into an alert for all available units, according to a police report.

Officers arrived in the 40 block of Wroe Avenue on Friday, Dec. 19, near 9 p.m. after a 911 caller said a man was suffering from alcohol poisoning. The alleged victim, 23-year-old Sidney J. Dickerson, quickly told the police to “get the (expletive) out of my house” and continued to verbally abuse the officers, according to the report.

When paramedics arrived, Dickerson refused treatment. Officers explained that Dickerson would have to sign a form stating he refused treatment for the personnel to leave, the report said.

Another man identified as Dickerson’s brother, 19-year-old Antowan Davis, tried to calm Dickerson. Davis refused to move from the front of the couch when the officers ordered him to do so, and officers called for all available West side units to respond to the address for fear it would get out of hand.

As officers struggled to put Davis into handcuffs, Dickerson — the man friends thought might have alcohol poising — jumped from the couch and tried to punch one of the officers in the face, the report said. Dickerson also ripped the shirt from one of the paramedics, the report said.

An officer soon tased Davis as he continued to fight with police. He then tased Davis again as Davis continued his struggle, according to the report.

The officer then tried to tase Dickerson, but the weapon “malfunctioned and shocked (the officer) on the right hand,” the report said. The taser then dropped to the floor, where it discharged again before the officer grabbed it and turned it off.

Another officer soon tased Dickerson, who was placed into handcuffs along with Davis. Both men were arrested on charges of obstructing official business and resisting arrest.

Police: Woman shot at Walmart by man just released from prison

MORAINE - The 28-year-old Kettering woman shot and robbed in a Walmart Supercenter parking lot will have to spend Christmas in the hospital after doctors removed a portion of her intestines, according to police.

Gina King is recovering from a single gunshot wound to the stomach she sustained Saturday evening, Dec. 20, after she was robbed by a man recently released from prison as she stood near her car at the Walmart, 1701 W. Dorothy Lane, Moraine Det. Paul Guess said.

Moraine police arrested Lashawn Porcher and Richard Elijah, both 46 and from Dayton, less than an hour after the robbery.

Elijah, believed to be the trigger man, was just released from prison on Dec. 18 for an April conviction for breaking and entering, according to jail records.

Witnesses said Elijah approached King as she wheeled a cart full of groceries and Christmas gifts to her car. King parked her car away from other cars deep in the lot so it wouldn’t get damaged by other motorists, Guess said.

“He told her to give him the purse or she was going to get shot,” Guess said. “She said ‘No’ to getting shot and then Elijah grabbed the purse.”

And for some reason, Elijah started to run away, but turned around and shot King, who fell to the ground screaming, Guess said.

Elijah then ran from the lot and over to a white Cadillac waiting in the parking lot of the Golden Nugget restaurant across the street from Walmart, Guess said. A witness spotted Porcher and Elijah and followed them in a car while talking to police on the phone, Guess said.

Police caught up with the alleged robbers and arrested them in at Moraine Auto Parts, 2833 Northlawn Ave.

“It was a huge break for us,” Guess said. “Without them, it would made it much harder to make an arrest.”

Police found the 9mm handgun used in the shooting on Sunday, Guess said. The gun was inside King’s purse, which was found underneath a car in the parking of the Golden Nugget, Guess said.

The Montgomery County Prosecutor’s office approved charges at about 3 p.m. Monday against Elijah for aggravated robbery with a deadly weapon, felonious assault to cause serious harm and felonious assault with a deadly weapon.

Porcher faces complicity charges of felonious assault with a deadly weapon and aggravated robbery with a deadly weapon. A court date has yet to be set.

A background check found Elijah has an extensive criminal record dating back to 2000, which includes arrests and convictions for drug possession, theft and numerous parole violations.

He was convicted of possession of crack in 2004, 2006 and 2008, according to court records.

Porcher has little criminal record and has never been arrested in Montgomery County prior to Saturday’s incident, according to jail records.

Police need help capturing Family Dollar robbers

DAYTON - Miami Valley Crime Stoppers is asking for the public’s help in identifying two men who robbed a Family Dollar store at gunpoint on Dec. 12.

The two men, one wearing a blue long-sleeve shirt and ball cap and the other a black hoodie and mask, walked into the store 440 N. James H. McGee Blvd. and demanded cash at about 8:45 p.m.

The men stole an undisclosed amount of cash and threw bleach on the clerk during the robbery, according to a police report. The clerk was not seriously harmed during the incident.

Anyone who knows information about the robbery is urged to call 333-COPS.

Shooting victim turns up at area hospital

DAYTON - Police called to the corner of Cornell Drive and Wesleyan Road of a man shot today, Dec. 19, thought it was nothing until the man turned up minutes later at an area hospital.

The man showed up at Good Samaritan Hospital at about noon with a gunshot wound to the abdomen and was immediately transported to Miami Valley Hospital, Lt. Patrick Welsh said.

Miami Valley is a Level 1 trauma facility and can better deal with gunshot victims, Welsh said. Doctors at Good Samaritan listed the man in critical condition before he was transported, Welsh said.

Homicide detectives are at the hospital now trying to figure out where the man was shot and who might have shot him, Welsh said.

Officials announce location of DUI checkpoint

DAYTON - The Combined Agency DUI Task Force of Montgomery County will be operating a sobriety checkpoint tonight, Dec. 19, in the 1600 block of South Smithville Road.

Law enforcement officials will be on scene from 8:30 p.m. to 2 a.m. The task force’s goal is to encourage those who consume alcohol find a designated driver before traveling anywhere, Miami Township Major John DiPietro said.

Toys for Tots volunteer charged with stealing donations

HUBER HEIGHTS - A volunteer with the Miami Valley branch of the Toys for Tots campaign has been arrested on charges she stole $3,700 worth of donated gift cards.

Natasha White, 36, was arrested by Huber Heights police on Monday, Dec. 15, after she admitted to stealing the donated gift cards, Officer Mark Bruns said.

The arrest came after store officials from an area Meijer noticed in early December that gift cards donated to the Toys for Tots program were used to purchase gasoline, cigarettes and alcohol, Bruns said.

“They were able to match up the surveillance tape with the use of the gift cards and determined it was (White),” Bruns said.

White, a Toys for Tots volunteer for at least two years, approached the Meijer store in early November about donating gift cards to the program run by the U.S. Marine Corps Reserves.

Police say White, of 6107 Buckman Drive, also used some of the gift cards to buy gifts for her two children.

“We were able to recover some items from the house,” Bruns said.

A background check discovered White was sentenced to five years of community control for forging documents in 1999. She is now in jail on $100,000 bond and faces one felony count of theft.

Robber hits chicken joint again

DAYTON - Police are looking for a masked man who robbed a Church’s Chicken restaurant at gunpoint on Wednesday, Dec. 17.

A store employee said the same man who robbed the restaurant at 529 North Broadway St. six months ago, returned at about 3:45 p.m. Wednesday and displayed a handgun, according to police report.

The gunman, described as a black male, age 30 to 35, 6-feet-4 and 200 pounds, told the restaurant clerk to empty the cash register, the report stated.

The clerk had just changed out her register and had just $65 in the drawer, the report stated. She handed the gunman the money and he fled the restaurant, the report stated.

Restaurant employees said the man was wearing a long black puffy coat, blue jeans and a black ski mask, the report stated. Employees said they recognized the suspect’s voice and appearance as the same from the earlier robbery.

No one was harmed during the robbery and police are still searching for the suspect. Anyone with information is urged to call 333-COPS.

Police investigating two unrelated shootings

DAYTON - Two men were rushed to Miami Valley Hospital Thursday evening, Dec. 18, after they were shot twice during separate incidents, according to police.

A 28-year-old man is in serious condition after he was shot twice in the leg while inside his house in the 900 block of Westwood Avenue at about 5:30 p.m., Lt. Brian Johns said.

The victim told police he was shot by a man police later named as suspect Brandon Foster after the two men scuffled inside his house, according to police.

“The victim said that Foster allegedly owed him some money,” Johns said.

Police found a 9mm handgun inside the victim’s house, along with cocaine, marijuana and heroin, according to police.

The victim is expected to survive, Johns said. It is unclear if the victim will face charges related to items found inside the house.

Later, police were called to the 3000 block of Haberer Avenue at about 9:45 p.m. on shots fired and found a 21-year-old man with gunshot wounds to the lower torso, Johns said.

The victim said he was visiting a friend when a gunman pulled up in a rusty black pickup truck with plastic over the passenger-side window and started firing, according to police.

The victim was taken to the hospital and treated for non-life threatening injuries, Johns said.

Johns said there is no motive for the shooting and there are no suspects at this time. Anyone with information is urged to call 333-COPS.

Man continues munching before arrest at fast-food joint

DAYTON — Police arrested a 39-year-old man on a charge of carrying a concealed weapon on Wednesday, Dec. 17, but not before he continued savoring his fast-food sandwich.

Officers responded to the Wendy’s at 1507 Wayne Ave. at 7:23 p.m. on a report that “an intoxicated white male is sitting in the restaurant with a handgun in full display for customers to see,” according to a police report. Officers soon identified the subject, Herbert Leeper, sitting at a table inside the Wendy’s, the report said.

One officer approached Leeper as the other looked around the table for the alleged weapon. When an officer asked Leeper to put his sandwich down, he raised it for another nibble. The officer asked again, and Leeper put down the sandwich.

While searching Leeper, officers discovered a black .22-caliber revolver loaded with five live rounds in one of his front coat pockets. He was booked into Montgomery County Jail.

It’s been a good week for area law enforcement

DAYTON - Being a cop is just like any other job.

Things pile on top of the next thing you haven’t gotten to yet and you never seem to be able poke your head above the mounting work.

On top of that, police have to deal with nagging reporters and nutcases. I know, what’s the difference? Funny.

But so far this week …it has been a good week for area law enforcement. It was capped off today by the arrest of 18-year-old Charles Ramey Jr. for the shooting of the Oxford Market store clerk on Sunday.

That came after Dayton and Trotwood police, along with the Montgomery County Sheriff’s department and U.S. Marshals tracked down Robert T. Young for the murder of David Watson inside a Trotwood bar last week.

With shrinkings budget and manpower this type of police work has become harder to maintain. But this week, law enforcement officials got it done.

Sex offender indicted for trying to abduct 9-year-old girl

DAYTON - A convicted sex offender was indicted by a Montgomery County grand jury today, Dec. 17, for trying to abduct a 9-year-old girl from her porch last week.

Kim Abney, 52, tried to pull the girl over a wall separating a duplex in the 1500 block of McLain St. he shares with the girl’s family at about 11 p.m. on Dec. 9, according to police.

The girl’s mother heard her child screaming and ran outside to find Abney grabbing the girl, according to police. Abney told the girl’s mother that he licked the child’s face and asked her not to call police, the mother told police.

Abney faces two felony charges of abduction and is in the county jail. He expected to appear in front of Judge Mary Wiseman on Dec. 23 at 8:30 a.m., according to jail records.

Abney was convicted of a lewd act with a child under 14 in San Diego in 1992.

Police don’t believe man who claims he was shot during robbery

DAYTON - You might recall a story we wrote Tuesday, Dec. 16, about Aaron Turner who said he was shot in the chest during a robbery attempt.

But a day later, police said they don’t believe Turner, who survived the shooting. They aren’t sure who shot Turner, but they are confident it wasn’t during a robbery, Lt. Patrick Welsh said.

“Mr. Turner is no longer cooperating and parts of his story aren’t adding up,” Welsh said.

Turner’s girlfriend, Tia Wilcox, said she called police at about 11:30 a.m. after Turner walked into his house at 1435 Tampa Avenue and said he had been shot in the chest, according to police.

Turner, 28, told police he was shot by two men while walking in an alley near Paul Laurence Dunbar Street near his house. Detectives found no blood in the area where Turner was allegedly shot or a blood trail leading to his house, Lt. Robert Chabali said.

Police did find blood in a basement bathroom sink, despite Turner saying he had been on the couch since returning home, according to a police report.

Officers also noticed a strong odor of marijuana inside the house and got permission from Wilcox to search the house, according to the police report.

Drug unit detectives arrived to find 15 pounds of marijuana and $14,000 in cash in the house, according to police.

Detectives also found a safe in the basement bathroom that’s front door had been broken off by a hammer and chisel, which were found lying next to the safe, according to the report.

Stolen checks were also found in the house, which could be linked to a recent home invasion in Miami Township, according to police.

Turner and Wilcox have yet to be charged with a crime, but detectives are trying to “untangle” what happened, Welsh said.

Two-cigarette beef helps land man in jail

DAYTON — An noisy party, argument about two cigarettes and reported break-in all led to the arrest of a man with outstanding warrants in Kettering and Colorado, but only after he hid in a closet and tried to escape, according to police reports.

John Anderson, 21, was arrested for resisting arrest following the incidents in and around the 100 block of Volkenand Avenue on Tuesday, Dec. 16. Officers responded to the address at 2:20 a.m. on a noise complaint and at 2:34 a.m. on the report of an argument.

The third dispatch came at 3:05 a.m. and led officers to a nearby house on Utah Court, where a complainant said “the guys from across the alley” were using a broom to break his storm door glass, according to the report. The complainant said he and the males were usually friendly, and they had played craps that night with cigarettes at stake, the report said.

When the crowd grew too large, though, the complainant asked the men to leave. Two of them, including Anderson, felt cheated out of two cigarettes, and an argument began that eventually led to the broken storm door, the report said.

Another police crew responding to the Volkenand address at 3:25 a.m. on the report of a disturbance discovered a man hiding in an upstairs closet. They removed a pocketknife from his pocket and sat him on the bed to question him.

At first, the man said his name was John Gerrards and spelled his last name “G-e-r-l-r-d-s,” the report said. The man was later identified as Anderson.

As an officer began to place Anderson in handcuffs, Anderson revolted, the report said. Anderson leapt from the bed and tried to push back the officer, but the officer shoved him back with both hands. Anderson again tried to get out of the room before a struggled ensued that included Anderson hitting his face on the ground and suffering a bloody nose and a swollen lip.

Officers soon learned Anderson had three warrants outstanding, including one in Kettering for driving under the influence.

MVH truck struck in hit-and-run (emphasis on run)

DAYTON — A Miami Valley Hospital-owned truck was struck by another vehicle whose driver took off on foot on Tuesday, Dec. 16, according to a police report.

Police responded to the accident report in front of 539 Wyoming Street at 4:38 p.m. as collisions around the Miami Valley increased due to poor winter weather. The truck’s driver told police a 1985 Ford Mustang traveling on Wyoming near the hospital lost control, went left of center and struck the MVH vehicle head on, the report said.

The truck’s driver pulled to the side of the road, expecting to speak with the other driver. Instead, the other driver had left the Mustang and was running westbound on Wyoming, the report said.

Police: Shooting might be drug-related

DAYTON - Police said that the shooting of a 28-year-old man at about noon today, Dec. 16, could be drug-related.

Aaron Turner suffered a non-life threatening gunshot wound to the chest as he walked in an alley near Paul Laurence Dunbar St., his girlfriend told police. Turner said he was confronted by two men who were trying to rob him, according to 911 audio.

Turner then made his way to his girlfriend’s house in the 1400 block of Tampa Avenue, according to police. He was taken to Miami Valley Hospital and has since been released.

But it doesn’t end there.

Drug-unit detectives later searched the house discovered roughly 15 pounds of marijuana and thousands of dollars of cash, Lt. Matt Carper said.

Turner nor his girlfriend have been charged for any crimes, but are being questioned by police, Lt. Patrick Welsh said. There are no suspects in the shooting.

Fight erupts outside courtroom after sentencing in murder case

DAYTON - A fight erupted outside a Montgomery County Common Pleas courtroom Monday, Dec. 15, leaving one sheriff’s deputy injured and the mother of a homicide victim in handcuffs.

Judge Barbara Gorman had just sentenced Deanthony J. Williams, 18, to 20 years in prison for the June murder of Keanna Griffin when the fight broke out at about noon, Sheriff Phil Plummer said.

Williams, 56 Bish St., was facing murder charges but accepted a bill of information to a lesser charge of involuntary manslaughter, two counts of felonious assault and carrying a concealed weapon.

Williams shot Griffin, 22, and two other men as they stood on the front porch of a Westdale Terrace apartment building 230 Westdale Court, according to Dayton police.

Griffin, who had two children, died from a gunshot wound to the head hours after the shooting, according to the coroner’s office. The other two men survived minor gunshot wounds.

The shooting was over a stolen cell phone, Dayton police Sgt. Gary White said.

After the courtroom emptied, Griffin’s mother, Delores Taylor and Williams’ mother exchanged words and a scuffle ensued, Plummer said.

“During the altercation, Deputy Dave Cole had his radio earpiece broken after he was punched in the head, and he had to seek medical attention for a hand injury,” Plummer said.

Taylor, 46, was arrested for assaulting a police officer and resisting arrest, according to jail records. Williams’ mother also intends to press charges, Plummer said.

Wheelchair burglar hits local restaurant four times in a week

DAYTON - Franco Germano did a double take when he saw a one-legged man hopping through the hallway of his restaurant, Franco’s Ristorante Italian, at about 4 a.m. on Dec. 7.

Germano saw the wheelchair-bound man on surveillance tape again the next day. And the next day. And the day after that.

Police said they believe Owen Robinson, 28, is the one-legged man who hopped out of his wheelchair and burglarized the restaurant four separate times in five days, starting on Dec. 7.

“I’ve never seen anything like it; he was just hopping,” said Germano on Monday, Dec. 15, at his restaurant at 824 E. Fifth St.

Robinson was wheeled into the Safety Building in handcuffs on Friday morning, Dec. 12, and confessed to the burglaries, according to police.

“There were two police reports, but the owner said he was burglarized four times last week,” Lt. Patrick Welsh said.

Robinson can be seen on the surveillance tape rolling up to the restaurant in the early morning and then hopping on one leg inside the restaurant.

“He is a smart guy because he knew it takes police about 10 minutes to get here once the alarm (sounded),” Germano said. “Every time he was in and out of here before they got here.”

Germano said he stopped calling police after filing two reports, one on Dec. 9 and the other Dec. 11. In the former instance, Robinson jimmied the lock and stole “a few hundred dollars,” out of an office, Germano said.

Robinson allegedly broke the glass of the same door on Dec. 11 and stole four to five bottles of wine valued at about $40 each, Germano said. Those are the only items believed to be missing from the restaurant, Lt. Larry Faulkner said.

Germano said he believes Robinson’s “lack of options” to transport items is the reason he didn’t take more from the restaurant.

Robinson faces felony charges of breaking and entering, along with a misdemeanor charge of drug abuse. A background check found he has a lengthy criminal dating back to 1999, which includes arrests for theft, drug possession and panhandling.

Police: Store clerk shot in chest during robbery

DAYTON - Police are looking for two men who shot a clerk in the chest during a robbery at the Oxford Market Sunday afternoon, Dec. 14.

Police were called to 650 Oxford Ave. at about 1:15 p.m. and found the store’s employee bleeding on the floor. He was immediately taken to Miami Valley Hospital, according to police.

It is unclear what the men took from the store, according to police. The clerk’s condition has since been upgraded to stable, according to police.

Detectives are reviewing surveillance tape that captured images of the two men, Det. Cayce Cantrel said.

The market has been the scene of nearly 20 crime-related incidents in the last five years, according to police reports. The latest report was in September when employees of the market arrived to find bullet holes in the front door and at least two bullets inside.

No one was hurt in that shooting, according to the report.

Police: Man shot after arriving home

DAYTON - Police are investigating the shooting of a 51-year-old man after he pulled into the driveway of his home in the 1100 block of Crocus Drive Thursday, Dec. 11.

Sherman Holmes said he had just arrived home at about 12:30 a.m. when two black males wearing masks approached him and asked for “a light,” according to a police report.

Holmes said he got scared, ran to a neighbor’s house and started banging on the door, the report stated. When no one answered, Holmes turned around and of the men shot him in the thigh, the report stated.

The gunman tried to fire again, but the gun malfunctioned, Holmes told police. The gunmen took Holmes’ keys and the two men took off.

Holmes was taken to Miami Valley Hospital where he was treated for non-life threatening injuries and released, according to the report.

Holmes said he did not know the suspects or the gun used in the shooting. Anyone with information is urged to call 333-COPS.

Teenager reportedly shot in buttocks

DAYTON - Police are investigating a shooting of a 16-year-old boy in the 700 block of Cleverly Road late Thursday night, Dec. 11.

Officers were dispatched at around 9:20 p.m. after the boy called 911 and said he had been shot in the buttocks on Elmhurst Road by a “group of men,” Lt. Brian Johns said.

The teenager allegedly ran from Elmhurst to a house on Cleverly and called police, Johns said.

The bullet exited out his leg and the teen was taken to Miami Valley Hospital for non-life threatening injuries, according to police. Police have no suspects.

The teenager couldn’t give a description of the men who allegedly shot at him, Johns said.

Homicide detectives at scene of stabbing

DAYTON - Homicide detectives have been called to the scene of a stabbing in the 900 block of Walton Avenue Thursday evening, Dec. 11.

Alvin Abney, 50, was rushed to Miami Valley Hospital at about 5:30 p.m. after he was stabbed in the chest, Lt. Brian Johns said. Abney is still alive, but in critical condition, Johns said.

Abney told police a black man in a hooded sweatshirt knocked on his door at around 5:20 p.m. and started an argument, according to police.

Abney said he and the man began to scuffle and the fight spilled out onto the street, according to police.

“He thought at first he had been punched in the chest,” Johns said. “But he went in the house and discovered he had been stabbed in the heart.”

Abney said he did not know his attacker, but did say he kept asking for someone that did not live at the house.

There are no suspects as of 8:15 p.m. and no other details are known about the male attacker, Johns said.

Man accused of threatening ex-girlfriend, tying up puppy

DAYTON — Police arrested a Dayton man Tuesday, Dec. 9, after he allegedly threatened to burn his ex-girlfriend’s house down and tightly restrained a six-week-old puppy by the neck in the cold rain, according to a police report.

Eric Priest, 40, was arrested at 4:40 p.m. in the 40 block of Quitman Street on charges of aggravated menacing, aggravated burglary and cruelty to animals. Police responded to the apartment building after receiving three calls that the complainant’s ex-boyfriend, Priest, was trying to get into her residence.

When police arrived, they made contact with Priest and immediately confiscated a red box cutter, according to the report. Another officer, with knowledge of Priest’s removal from the property earlier in the day, asked him about a puppy, and Priest pointed to an area near the building’s front door, the report said.

There, a black puppy estimated by officers at six weeks old was lying next to the building in the mud and shivering in the chilly rain. It was tied to a small wooden table with a brown leather cord, the report said. The cord was tight enough around the puppy’s neck that an officer could not push her finger between the cord and the neck, the report said.

Priest said he had just obtained the puppy that day and brought it to the apartment so it could stay with his ex-girlfriend, but she told Priest she’s not allowed to have dogs. Officers could not untie the cord and were forced to cut it from the dog’s neck.

The complainant then told police Priest had been removed from the property earlier in the day after he pounded on her door, said he would break the window and told her he would burn her house down, the report said. Officers found foot marks on the complainant’s front door and fresh splintering around the door frame, the report said.

The screen to the bedroom window was also removed, but there were no signs of forced entry at the window, the report said.

Priest was arrested and taken to Montgomery County Jail. The puppy was taken to the Montgomery County Animal Shelter, the report said.

Mysterious stabbing call leads to uncooperative victim

DAYTON — Police received a report of a stabbing involving a group of 20 attacking a man on Tuesday, Dec. 9, in the 40 block of Boltin Street. The victim, the call said, fled toward a nearby Circle K convenience store.

When police found the alleged victim at 10:52 p.m., all he would say, over and over, was, “I (expletive) up. I (expletive) up.”

When the man calmed, he told police he was walking down the street when three males began yelling at him. The small group then gathered more people from nearby houses, and the larger throng attacked him.

The victim would not say if he was stabbed, and he was uncooperative with police, telling officers he didn’t want help. The man’s brother said a white male with a tattoo on his neck stabbed the victim, but he wouldn’t say anything more.

Police noticed a possible stab wound on the victim’s right shin, and they photographed it. The victim was eventually taken to Miami Valley Hospital for treatment.

No arrests have been made.

Police: Traffic stop leads to brief standoff, drug bust

DAYTON - A routine traffic stop Friday, Dec. 5, turned into a brief standoff between one Dayton police officer and a man armed with a handgun.

Officer John Riegel was patrolling the 3300 block of Haberer Avenue at about 8:30 p.m. when he noticed a Chevy Impala fail to signal a left turn, according to a police report.

The Imapala then pulled into a parking lot, where Riegel approached in his marked police cruiser with activated overhead lights, the report stated.

The driver, Antonio Houston, and a passenger got out of the car as Riegel drove up, and the officer ordered them both to get back in the car.

Both men got back in the car, but Houston refused to close his door, the report stated. Houston refused numerous requests to close his door, and as Riegel approached he noticed Houston had a .38-caliber revolver in his hand, the report stated.

Riegel refused to put up his hands as Riegel retreated to his cruiser and took cover, the report stated.

As he approached again, it appeared Houston was trying to unload the gun, the report stated. Houston then got out of the car, hit his knees and threw the gun underneath the vehicle, the report stated.

Houston then took off on foot. He was caught minutes later at McCabe Park a quarter-mile away by responding officers. Police found baggies of marijuana and nearly $5,200 in cash in Houston’s pockets, according to the report.

Houston told officers he had been out of work since September and the money was from his unemployment checks he’d been saving, the report stated.

Houston offered no explanation for the stolen gun or the nearly 350 grams of marijuana, the report stated.

He was arrested on felony charges of carrying a concealed weapon, receiving stolen property, drug possession and having weapons while under disability.

The passenger, Maurice Pique, was issued a misdemeanor citation after police found a small amount of marijuana in his pockets, the report stated.

DNA match links Dayton man to 10-year-old rape

DAYTON - A DNA match has led to the indictment of a 35-year-old Dayton man for - what police are calling - the “brutal assault” and rape of a woman in her home in December of 1997.

Authorities arrested Demetrius P. Chambers on Nov. 27 in the 1500 block of North Keowee Street at about 6:30 p.m. on a warrant for rape, according to the Montgomery County Prosecutor’s Office.

The warrant was issued after a grand jury indicted him on felony charges of rape, aggravated robbery and aggravated burglary on Nov. 7, according to court records.

The case was reopened after Chambers’ DNA sample was entered into a national database while he was incarcerated at the Belmont Correctional Institution. His profile generated a hit in the rape of a woman in the 2200 block of Emerson Avenue in, authorities said.

“We reopened the case after the DNA match and that, along with other evidence, is what led to the indictment,” Lt. Patrick Welsh said.

Police then located the female victim and she picked Chambers out of a group of photos as her attacker, Welsh said. The victim’s name is being withheld for her protection.

Investigators said Chambers knocked on the woman’s door and forced his way into the house when she opened it.

“The woman was expecting someone else and opened the door to find Mr. Chambers,” Welsh said.

Chambers held the woman against her will, raped her and then stole undisclosed items from the house before leaving, according to police.

Chambers, 57 Crown Ave., is in jail on $500,000 bond. His next court appearance is scheduled for Dec. 18, according to jail records.

He has a long criminal history, including convictions for escape in 1996 and receiving stolen property in 2005, according to court records. He also been arrested for carrying a concealed weapon, drug abuse and public indecency.

Police seek alleged arsonist stalker

DAYTON — Police are searching for a woman who allegedly set fire to the car of a woman who believes the suspect is stalking her, according to a police report.

Police responded to the report of a car fire in the 4900 block of Northcutt Place at 3:53 a.m. on Wednesday, Dec. 3. They interviewed a witness who said he was outside smoking a cigarette when he saw the suspect pacing back and forth near a red 1997 Dodge Intrepid in the parking lot, the report said.

The witness told police the suspect was carrying a gas can and siphoned gas out of the car. She then poured the gas over the trunk of the Intrepid and on a line through the parking lot and lit the gas, the witness told police.

The witness said he yelled, “Hey, what are you trying to do, kill us?” He startled the suspect, who got into another car and drove off, the witness told police.

The Intrepid’s owner told police she believes the suspect is a woman who has been stalking her, and her description of the suspect matched what the witness had told police. The suspect had also threatened the life of the Intrepid owner’s boyfriend and had set his sister’s apartment on fire, the owner told police.

Man arrested for stealing cable, assaulting cable guy

DAYTON — A Dayton man was arrested Wednesday, Dec. 3, for allegedly assaulting a cable company investigator who had come to disconnect illegally wired service.

Police responded to the 1500 block of Kumler Avenue at 9:40 a.m. on the report an assault. A Time Warner Cable investigator told officers he came to the address for the third time for illegal cable hookup and proceeded to shut off the service, according to a police report.

The suspect then came outside and asked what was happening. When told his cable was being shut off, the suspect told the investigator he was going to get his gun and shoot him in the leg, according to the report.

The investigator told police the suspect then approached him and “struck me in the upper lip with his right forefinger,” according to the report. The investigator then called Dayton police.

The suspect first refused to come outside when told he was under arrest, saying the cable was already hooked up when he moved in. He told police he threatened the investigator but that he didn’t strike him, the report said.

Police arrested the suspect on charges of assault, aggravated menacing and unauthorized use of property.

Apartment roof catches fire at The Greene

BEAVERCREEK - Roughly 20 people had to be evacuated from apartments at The Greene Town Center after a fire broke out on the roof Wednesday night, Dec. 3.

Fire crews responded to Holly Drive at about 9:20 p.m. and found 10-foot flames shooting from the roof of a corner apartment next to the Adobe Gilas restaurant, Beavercreek Fire Department Battalion Chief Greg Connors said.

The flames were extinguished in about 10 minutes, Connor said. No one was seriously injured or displaced because of the fire.

Connors said the fire was caused by some welding done on the roof earlier in the day.

S.R. 4 reopened after fuel spill

DAYTON- The northbound lanes of State Route 4 near the Interstate 75 interchange have been reopened by Dayton police after a fuel spill forced crews to shut down the highway at about 3:45 p.m Wednesday, Dec. 3.

A fuel leak caused the highway to be shut down while sand was spread to soak up the mess, according to police.

It is unclear what caused the fuel leak.

Religious books, cookies allegedly stolen in separate incidents

Two reported thefts that allegedly occurred within hours of each other on Tuesday, Dec. 2, involved items one might not like to see during the holiday season — religious books and Christmas presents.

The first occurred at 7 a.m. in the 50 block of Grafton Avenue, according to a police report. The complainant said someone broke the passenger-side front window of her car and took two books titled “So You Want To Be Like Christ” and “My Utmost For His Highest.” The complainant also said a laptop computer was stolen, according to the report.

About three hours later, officers responded to a burglar alarm, this one in the 100 block of Notre Dame Avenue. Upon investigating, officers found the front door had been forced open and that the subject apparently went straight for a pile of wrapped Christmas presents in the corner of the dining room.

The subject removed just one gift, possibly because the alarm caused the subject to hurry out, the report said. The gift contained cookies that had been dipped in chocolate.

No arrests have been made in either incident.
