Police: Man drags, punches officer during drug bust

DAYTON - A 31-year-old man suspected of buying heroin from a house at 32 Utah Court is in jail after he dragged and punched a police officer Monday night, Dec. 21.

Benjamin J. Gulley walked out the back door of the house at about 10 p.m. as officers responding to a neighbor complaint about drug activity arrived to check the scene, according to a police report.

Gulley kept walking as Officer Jeffrey Downing was questioning what he was doing in the house. Gulley said he could not provide an identification, according to a police report.

As Downing questioned Gulley, a blue pickup truck pulled up with two white males inside. Gulley said it was “my ride” and he had identification inside the truck, the report stated.

Downing became suspicious as Gulley fumbled with items inside the truck and started reaching for things, the report stated. Then Gulley began to walk away from the truck.

As Downing escorted Gulley back to his cruiser in order to obtain some identification, Gulley took off running with Downing still clutching his jacket, the report stated.

Gulley dragged the officer as he tried to run away, then turned around and swung at Downing, hitting him in the shoulder, the report stated. Gulley then tried to get out of his jacket, when another officer arrived to help Downing subdue the suspect, the report stated.

Gulley kept swinging at the officers, so the officers started swinging back in order to subdue him, the report stated.

Once in handcuffs, police found heroin and marijuana in Gulley’s pockets, the report stated.

“I was getting it for a friend,” Gulley said. “I know it was stupid, but I was getting it for a friend.”

Gulley also said the two men in the truck were coming to pick him up because they wanted heroin, the report stated.

Those men were not charged, but Gulley was arrested on felony charges of assault of a police officer and drug possession, the report stated. He was also charged with resisting arrest.

Ive known him since i was about 12 years old and this is not in his behavior, ben has never been on herion so he had to be getting it from a friend, which is not smart but just for the record ive not known him to do hard drugs.

What do you actually expect oh I’m going to stop and cooporate with the officers demands I have two drugs on me which are classified as a schedule 2 substances in other words meaning prison time for him ask yourself exactly what grounds do they have to search him, because some neighbor said they thought the house was used as a location for drug activity or because of his appearance a police officer can say anything his word is not even considered to be questioned it’s almost like god himself said it so it must be true remember man is not perfect and without flaw even the supposedly most noble prejudge and make hasty decisions.

If you ask me the whole thing is racist - white guy walking out the back door of a house on Utah Ct. - of course he doesnt belong there! Since when was walking out the back door a crime? Now posession, thats another thing. But bottom line is the IMprobable-cause for the stop was racist! IMHO

Go figure, it was for a friend! Have fun in the slammer dude! I have to agree those sores look like those prevalent on so many drug users. They could be skid marks on his face from trying to evade and run from the police :) No one ever said lawbreakers were smart!

Why has he been released from the jail by the detectives and the prosecutor? He is also on probation. He’s a snitch, and a piece of sh*t thats why. God Bless his Loved ones. I pray for him.
