Brothers arrested in drive-by shooting at DeSoto Bass

DAYTON - Homicide detectives have arrested two brothers believed to be responsible for a drive-by shooting that left a man in critical condition, Monday, Dec. 29.

Tuvon Dudley, 19, of 1221 Superior Ave., and his 16-year-old brother were arrested at about 5 a.m. on felonious assault charges, Sgt. Gary White said. Police are not releasing the identity of the juvenile until charges are formally approved by the Montgomery County Prosecutor’s office.

Police are also not releasing the victim’s name or age for his protection, but he was shot once in the chest just after midnight Monday while inside a DeSoto Bass apartment at 72 Bragg Place, White said.

Residents at the complex said a group of people were partying in and outside of the apartment when an argument broke out at about 11:40 p.m. Dudley and his brother were then allegedly told to leave, White said.

The brothers then drove back to the apartment 30 minutes later and fired 15 rounds from about 10 yards away as they drove by, White said. Numerous bullet holes can be seen around the window and front door of the apartment.

“Officers were in the area and heard the shots,” White said. “We were able to make arrests after multiple interviews with witnesses.”

White said it’s undetermined if the shooting was gang-related, but said the two brothers have been involved in gang-related activity prior to Monday’s shooting.

“We are not sure why they were asked to leave,” White said. “We are fearful there could be some retaliatory shootings because of this so we are still investigating to see if anyone else was involved in the incident.”

A background check found Duvon was arrested in 2005 for receiving stolen property and for sexually assaulting a 14-year-old girl in 2007 when he was 17.
