Driver who hit and killed 12-year-old not under arrest

DAYTON - The 25-year-old man behind the wheel of a car that hit and killed a 12-year-old boy isn’t and never was under arrest, according to police.

Investigators with the traffic division of the Dayton Police Department needs time to reconstruct the scene, check out the vehicle and interview witnesses, Lt. Larry Faulkner said Monday, June 15.

Daquan “Day-Day” Sales died from significant trauma to his head, spine and neck after he was hit while riding his bike in the 300 block of Elmhurst Drive Saturday afternoon, according to the Montgomery Coroner’s Office.

His death has been ruled an accident, Coroner James Davis said.

“From our standpoint it has been ruled an accidental death, but that has little bearing on what the (county) prosecutor’s office intends to do,” Davis said.

The police are considering Sales’ death a vehicular homicide, according to the police report.

Faulkner said Prosecutor Mathias Heck wants a complete investigation done before his office considers any criminal charges against the drive. Faulkner did say the driver was given a blood test to determine if he was under the influence of drugs or alcohol at the time of the accident.

“It’s going to take us some time to wrap up the investigation,” Faulkner said.
