Man suspected in fatal hit and run arrested on unrelated charges

DAYTON - U.S. Marshals from the SO-FAST task force arrested the 25-year-old man suspected of hitting and killing a 12-year-old boy Saturday.

Antwonne McGinnis was arrested at his grandmother’s home at 315 Whitmore Drive this morning, June 16, about 11:15 a.m., Marshals spokesman William Taylor said.

“He was not arrested for the fatal accident, but for warrants of probation violations,” Taylor said.

Taylor said his office received arrest warrants for McGinnis from the Montgomery County Probation Office just before 11 a.m. this morning.

Court records show warrants for McGinnis arrest were issued for violating his terms of probation related to 2008 convictions for disrupting a public service and having weapons while under disability.

Taylor said he saw a story and picture of the 12-year-old boy’s relative on the front page of the Dayton Daily News today and made the decision to drop his other cases to arrest McGinnis.

“That picture was enough to tug at anyone’s heart strings and for the safety of the community we decided we needed to lock him up as fast as possible,” Taylor said. “We had 20 other warrants to serve but we dropped everything to work this one.”

McGinnis has yet to be charged by Dayton Police for the death of DaQuan Sales. Detectives are still finishing up their investigation before presenting charges to the county prosecutor’s office, Lt. Larry Faulkner said Monday.

“We are extremely happy and it’s definitely a breath of fresh air,” said Janelle Sales, DaQuan’s mother. “He should have been taken off the streets at the scene.”

McGinnis was driving without a valid license Saturday when police said he hit Sales and left the scene of the accident before returning a short time later.

Police said McGinnis smelled of marijuana and they are awaiting blood test results to determine if he was under the influence of drugs or alcohol.
