Murder charges filed against two in June shooting

DAYTON — Criminal charges were filed Tuesday, july 7, against two men in the shooting death of a man in Dayton last month.

Dalcapon A. Morris, 20, and Michael D. Guy, 19, were charged with murder, aggravated burglary, aggravated robbery, kidnapping and felonious assault in the June 2 incident that left Richard A. Pogue dead, Montgomery County Prosecutor’s Office spokesman Greg Flannagan said.

Pogue, 22, of Clayton was gunned down near midnight in a home at 1369 Kingsley Ave., in a killing police said was part of a robbery attempt in which two men kicked in the door before robbing and shooting Pogue.

Montgomery County Jail records indicate that Guy was arrested June 21 near his home in the 5100 block of Embassy Place. Morris was not in the jail Tuesday evening.

IT’S A SHAME HOW YOUNG BLACK FOLKS ARE THROWING THEIR LIVES AWAY ROBBING AND KILLING PEOPLE FOR NO REASON. WHAT I DON’T UNDERSTAND IS WHY DON’T THESE KIDS DIRECT THEIR ENERY SOMEWHERE ELSE. IF THEY WANT TO SHOOT AND CARRY ON LIKE FOOLS WHY DON’T THEY JUST JOIN THE ARMED FORCES AND GO TO IRAQ SOME WE CAN GET SOME OF OUR OTHER LOVED ONES HOME. INSTEAD OF PUTTING THESE KIDS IN JAIL, LETS SEND THEM TO IRAQ AND DON’T PAY THEM JUST FEED THEM AND TRAIN THEM TO FIGHT AND IF THEY RETURN THEY WILL BE FREE.

I am a Viet Nam era Veteran, I volunteered. During that time there was something called a draft and the military was desperate for new recruits. If you happened to find yourself in a courtroom, being considered for felony charges the judge would tell you to turn around and look at the two gentlemen in the back. There stood two recruiters, one from the US Army and another from the US Marines. The judge then told you, you have a choice. You can go with either one of these men or you could go to prison. If you were smart, you made a choice and picked one. If not, you went straight to jail. I have no doubt that choice saved a lot of young men from a life of crime and put them on the road to a successful life.

Why did Michael Guy believe it was OK to go into Richard A. Pogue’s house and rob him at gun point? Why did Michael Guy believe it was Ok to murder Richard A. Pogue when Poque did not cooperate with the robbery? The answer is obvious. Why not, he has robbed people at gun point before and it did not cost him anything. Personal experience with the justice system in Montgomery County has taught him that there is no one in the world that is going to stop him from doing what ever he wants to do. You will not read the following facts in the DDN. I now have absolute proof of the reason why, but more on that later. Court records show that on 9/9/2008 Michael Guy was arrested on charges of AGGRAVATED BURGLARY On 09/23/2008 judge SINGER set bond at $50,000.00 CASH. On 10/01/2008 INDICTMENT FOR 2CTS. AGGRAVATED BURGLARY (Physical harm) FILED. On 10/09/2008 Guy applied for a free lawyer. On 10/23/2008 MOTION OF DEFENDANT FOR BOND REVIEW FILED. Attorney: POPP, VINCENT P (0022231). On 11/13/2008 judge SINGER reduced the bond from $50,000 cash to the electronic home detention program for Guy to live with his sister. On 03/04/2009 ALERT ISSUED ORDER OF ABSCONDER CAPIAS- LOCAL. Which means judge singer let him out of jail free and Guy screwed that up. On 03/04/2009 mat heck’s assistant district attorney kirsten knight (0080433) allowed Guy’s free lawyer to go judge shopping. (Which in itself is a violation of court rules)Judge WAGNER rewarded Guy’s refusal to follow judge singer’s court ordered home confinement by eliminating the ankle bracelet and reducing Guy’s bond to $10,000. The following is from the testimony at the preliminary hearing for Guy.” The defendant was the fifth or sixth one to come up the stairs and was asking where the gun was”. “He (RODAYE BOZEMAN) was unsure whether the defendant was beating up his brother (BRANDON BOZEMAN) (because he himself was being beaten with hands, fists, and guns) before he and his brother were marched hostage style out of the apartment at gun point. On page 13 the witness states that, “they all back up, guns up and I can honestly tell you Mikey had one at hat point.” Page 14, question: “and you see that Mikey has a gun…” Answer: “Right”. judge wagner reduces Guy’s bond and lets him out in spite of this testimony. 3 months later while out of jail free once again Dalcapon A. Morris, 20, and Michael D. Guy, 19, were charged with murder, aggravated burglary, aggravated robbery, kidnapping and felonious assault in the June 2 incident that left Richard A. Pogue dead. Guy was set to go to trial for 2CTS. AGGRAVATED BURGLARY on 8/19/09 before judge singer. Why should Michael Guy stop robbing people at gun point? judge singer and wagner had a chance but did not give him a reason. I wonder what Richard A. Pogue’s family thinks about that?

Just tell let you under educated people Mikey Guy never went inside richard Pogues house it was a a known drug ares…So dont talk about s**t you dont know….Flat out..

Well my above comment came from anger due to the fact him and richard where good friends…They been known each other since Mikey was 13…I cant imagine or understand why he would do something of this nature to a friend of his…I guess the proof is in the making,but answer this for me detectives of this case why has noone yet to look for DNA if there indeed was a fight,which there was considering the scratch…Your going off the word of thee other suspects gilfriend….Not a good look,but you dont even have him in jail with Michael…Seems to me theres more to this than many of you know…Catch the other suspect before you put the sole blame unto someone else….

and if this is how friends treat you I guess its safe to say i’ll have to teach my 3 year old son that friends arent worth having if this is how they repay you….Redd was more then just a friend to me and he’ll be missed…R.I.P REDD!!

The sad news is that a fellow american is yet again gone. To much time is spent trying to figure out why somenone has done what they have done and what can be done to fix the problem, but the truth is that its time to PROTECT your children and TEACH them right from wrong. It all starts at home. I have two little boys who I hope one day doesnt face the prison system and is not a victim of crime, but that is something I intend on teach and guiding them through. To many parents are not there for their children. Im not saying the either the victim or the assaultant’s mothers and fathers were not involved in their childrens life BUT I beat there are things both sets of parents can look back on now and say “THERE WAS MORE THAT WE COULD HAVE DONE, but now it is to late”. Wake up Dayton…this is only one situation that should send up a GIANT red flag out of thousands each year….start being there for your babies before it’s to late! -Concerned Mom of two..
