Updated with Strickland response- Rep. Morgan takes public records case against Strickland to Supreme Court

Rep. Seth Morgan, R-Huber Heights, today, April 6, took his public records case against Gov. Ted Strickland to the Ohio Supreme Court.

Morgan previously had filed two public records requests with Strickland’s office seeking the documents that are the basis of Strickland’s “evidence-based model” for school reform and school funding. Strickland so far has not communicated directly with his office, Morgan said.

Morgan has petitioned the court to require the Strickland administration to comply with Ohio’s public records laws by turning over the evidence used to create the governor’s education plan.

The lawsuit also requests statutory damages and attorney fees and costs. Morgan said he hopes for a speedy response.

“We need to if were going to make an informed decision on this budget,” Morgan said in a telephone interview.

Amanda Wurst, Strickland’s spokeswoman, said Morgan’s request was so broad that it could take “months to compile the responsive documents.”

While the governor is not required to comply with such overly broad requests, Strickland’s office is identifying the materials that could be responsive, Wurst said.

She said every legislator had access to a 400-source bibliography used for Strickland’s plan and many of the reports are available on line.

Also, Strickland held 17 public regional forums over the past year on his plan and information on them is available at conversationoneducation.org, said Wurst.http://www.ohiochannel.org/multimedia/programs/program.cfm?programid=107678&sitedisplay_mode=2

Strickland’s plan calls for a longer school year, a longer school day, all-day kindergarten and other requirements. Critics have questioned whether it provides enough money, particularly for low-wealth districts.

School funding and the school reform plan are part of the proposed two-year budget now under consideration by the House.

Morgan is ranking member of the House Finance Committee’s Primary and Secondary Education Subcommittee.

Thank goodness for Rep. Morgan,Strickland is not just content to take your money.He is after our children for the next social experiment.With all of the excellent districts in the state the best idea he has is more time and money.

Dayton public schools, now there is a real beat down. There is a reason that anyone who can and most who can’t still get out of Dayton, to get away from the school system.

Rep. Morgan’s requests show that Emperor Strickland has no clothes when it comes to his education plan. His administration can try to spin about having produced a bibliography, but parents will see through this and will know that he doesn’t really have a solid basis to lengthen the school day and year while also hurting school competition. Even students know that you can’t just turn in a list of references and expect to get a passing grade on a research project. When the stakes are our entire state’s education plan, let’s agree that we should require our governor to follow through and produce evidence or modify his plan.

I don’t know much about this plan. I do know that if it passes as written, charter schools are going to suffer, if not be shut down altogether. My kids are getting a far better education at a charter school than they ever did at DPS. For the record, I’m a registered democrat, but in NO WAY did I elect this clown!

KevinBob, the lawsuit had to do with banks rejecting loan applications of minority applicants while approving loan applications filed by white applicants with similar financial characteristics and credit histories. It didn’t “force” banks to make loans. Only a Limbaugh groupie would twist the facts.

The mess Bush left? Something an uninformed Obama zombie would say. All one needs to do is research who is responsible for the complex mortgage debacle. One fact is is that Obama was a lawyer in a lawsuit that forced banks to make mortgage loans in 1995: (Buycks-Roberson v. Citibank Fed. Sav. Bank) It was lawsuit cases like this that forced banks into making shaky loans to unqualified people. Bush’s administration was partly responsible but this crisis has been building since FDR days in the 1930s.

Hey Mark, look at the numbers, inner city schools get about double the money from the state and federal government that sub-burb schools get. Money has nothing to do with it. Most sub-burb schools spend less than $10, 000 per student, Dayton spends about over $16,000. Strickland has no plan on the school system and used that as a platform during the election. He continues “status quo”.

School funding is the primary reason suburb schools get a head start over inner city kids. Kids that don’t get an fair start, very rarely catch-up to the kids that got a head start. That’s the dirty little secret in America - how we keep our poor down and eliminate competition. Bette wake-up city folks. The system is rigged against you.

Politicians are liars and they steal lollypops from children. Do you expect a politician, protected by the largest free Gestapo ever created, (the media), to respond to a another useless politician? As all of you bumble around in front of the castle with your torches and pitchforks (no weapons allowed, they’ll be banned & confiscated shortly), remember who put them there. As was said in “The Wizzard of Oz”: “Pay no attention to the person behind the curtain!!!” He’s not paying attention, and won’t pay attention, to you. You elected a trained psychologist to be your Governor? Sounds like OZ to me!

When a politician uses a term like “evidence-based model”, you should always expect that the “evidence” is never going to show up. Was Strickland hoping to cram this through the legislature before anyone asked? Who does he think he is, an affirmative action caste president?

I don’t know how long it’s been since he asked for the records, the article doesn’t say, but I hope this isn’t comparable to Obama only being in office for less than 3 months and the Reps expecting him to have the mess that Bush left cleaned up by now.

MMS, so had this been a Dem asking for papers from Former Gov Taft, you would be all upset that Taft was dragging his feet. SOOOOOO we have a Rep asking for Public Papers and Guess who is dragging his fee, a Dem. Figures.. Do as I do, not as I say.

My thought is that Morgan is just trying to make a name for himself. Like the Republican who preceded him, he is a follower not a leader. One does wonder who is pulling the strings. For the record: I am an independent.

What do you mean Rep. are litigious, MMS? When it comes to enacting laws that cost real money, I want to know that legislators, Rep and Dem are ensuring that all documentation is provided and that there are no hidden costs. With the recent AIG bonus debacle buried in 1200 pages of legal jargon that no one read, I am glad someone is taking our leaders to task when it comes to documenting their proposed programs.
