Secretary of State asks Husted for more evidence to prove residency

Ohio Sen. Jon Husted, R-Kettering, must provide the state’s top election official with evidence that he lives in the Kettering home where he is registered to vote, according to a decision announced Tuesday, April 7, by Ohio Secretary of State Jennifer Brunner.
Brunner said she was not provided with enough evidence of Husted’s residency to make a final decision on breaking a February tie vote by the Montgomery County Board of Elections on the residency question.
She said she will hold the “matter in abeyance” to allow Husted to provide additional documentation. She is preparing a list of documents she wants and at this point is not using a subpoena, said Brunner spokesman Kevin Kidder.
Husted, who plans to run for secretary of state in 2010, faces complaints that his legal residence is not in Kettering. Husted says he lives in Kettering but also stays with his wife and kids at his wife’s Upper Arlington home. He could not be reached for comment.
Husted was Ohio Speaker of the House when the complaints were filed with the board of elections and was elected in November to represent the 6th District in the Ohio Senate. The board of elections is considering his residency for voting purposes. If it is determined he does not live in his district the Ohio Senate would separately consider that matter. He could be forced to forfeit his seat if it is determined he does not live in the district as required by law.
In his January testimony before the local board “many of Husted’s statements were unclear, incomplete, or partially contradictory,” said Brunner, a Democrat who plans to run for U.S. Senate in 2010.
“From his testimony alone, it is not clear whether Husted is a Montgomery County resident who periodically remains in Franklin County or a Franklin County resident who periodically travels to Montgomery County,” Brunner said.

This isn’t a question of whether Husted does a good job or not. This isn’t a question of whether his constituents vote for him or not. This is a question of residency. If he didn’t reside in the district that elected him, then he was not qualified to run. A candidate who doesn’t meet the qualifications for his office may not be elected, regardless of the number of votes he attracts. The Board of Elections are required to judge Husted’s qualification for office. The board is split 50/50 between the parties, and predictably, came to a split decision along party lines. In such a case, the Secretary of State casts the deciding vote. Brunner doesn’t have to allow Husted to present ANY evidence to her. She could decide right now. However, she is. That’s to her credit, whether you agree with her politics or not. The rule of law is paramount; we cannot continue as a republic without it.By shellymoe

I think the MCBOE has wasted enough time and money on this. Wanting to verify his residency for voting purposes? Like his ONE vote for whomever and whatever issues will over-turn results! As for Brunner, she’s a goof. She’s the reason we had to do paper ballots. Why? Because she doesn’t “like” the machines (as I was told by a MCBOE official during a training class)! Enough is enough, why are we waisting all this money on this bull s_t. Just hire a private investigator to sit on the house for about three months or better yet define residency and then see if he’s meeting the definition. Once again our system shows just how incompetent they really are, pay me to sit on his house I could use the extra money seeing how you crooked politicians have spent everything and put the whole nation in the boat were currently in. It’s so nice to see that while everyone is losing jobs and homes our politicians feel the need to cause these out landish personal issues that cost more and more tax payer money’s. It is clear that Husted resides in Columbus, not Kettering. Saying other politicians violate the residency law is no excuse. His record, which is arguably a good one, is not relevant. But Brunner’s inherent bias as a Democrat is relevant. Just like it was for Katherine Harris in Bush v. Gore.By DHampton100

It amazes me that so many people are willing to accept illegal behaviors from a public official because, in their opinion, “he doing a good job”. By that measure why don’t we allow him to steal, rape and pillage? He got caught, period! He’s a lying sack of crap and he should be tarred and feathered and run out of town! Perhaps to Columbus or shall I say “Upper Arlington” where the most privileged reside in Franklin County. Why is it that breaking the rules is OK when it’s your guy who does it? My God - the guy was Ohio Speaker of the House and did a great job. We should be luckey to have him representing us and proud that he is a UD graduate and from Montgomery County. Anyone knows, as Speaker of the House, you need to be in Columbus a lot so this is not an issue. It is justan issue to the Dayton Democrats that are bitter that they haven’t produced anything better than the lazy and lame Paul Leonard in recent memory! Let’s see here….the lady who holds the position that Husted is going to run for is allowed to do this crap? Hmmm….Lynn Hulsey? Who’s she? She is terrible, Husted has done more for the entire Miami Valley than any politician in the history of Ohio politics. Look up what he’s done. Where’s the even coverage? Many democrats actually like Husted because he is for job creation and education. Hulsey just takes pot shots at any Republican. Hulsey is a pathetic left wing writer who hates anyone with an (R) after their name. She needs to go back to writing for the National Enquirer, I liked her better over there, at least you could laugh at what she wrote there. Regardless of what anyone thinks of Husted, or whether he’s being totally honest about this, do you really think an election outcome should be overturned by the decision of one person, or even the five people on the Board of Elections? Every argument being made about how awful Husted is, can be made when he seeks re-election next. On the other hand, what if the people of the district were to elect him again, even if it were proved he misled people about this? Jennifer Brunner is an incompetent hack, and the state will be better off when she is history, in 2010 or whenever….Husted is absolutely not my favorite by any means, and it pains me to seem to defend him, but Brunner’s only focus seems to be on short-circuiting the political process in her party’s favor. Are we to believe that a competitor for her position is the ONLY elected official who spends more time in Columbus than their home district? I don’t think some of you comprehend what Ohio’s residency laws are. Here it is: section (D) of ORC 3503.02 Residence determination rules.D) The place where the family of a married person resides shall be considered to be the person’s place of residence; except that when the spouses have separated and live apart, the place where such a spouse resides the length of time required to entitle a person to vote shall be considered to be the spouse’s place of residence. He’s permitted to have a residence in Columbus as well, but when the legislature is on recess or any break, he should be in his district, not living with his wife and children in Columbus. How many State Representatives and Senators actually live full-time in their district? How many either buy or rent a place in Columbus? I believe if you maintain a residence, pay taxes, upkeep and such it should be considered a residence no matter how often he is there. Exactly my point, no matter the outcome, Brunner is able to eliminate her biggest competition. If Huested has to prove his residency, time for all of the occupants in the State House to do the same. Their job is in Columbus, of course you will spend most of your time there, I’d be pissed if Huested was not in Columbus. They have recesses for the politicians to come back to the district, which Huested does on a regular basis. He is being sought out because he is a serious threat to Brunner next year.
