Ohio senator to introduce legislation challenging health care bill

State Sen. Shannon Jones, R-Springboro, on Wednesday, March 24, is set to unveil legislation that would prohibit requiring individuals to obtain health insurance policies.

Jones and Sen. Tim Grendell, R-Chesterland, have scheduled a news conference to discuss the legislation which would undo part of the historic health care bill signed into law by President Barack Obama.

Grendell, with Jones as a cosponsor, already has proposed a constitutional amendment similar to the legislation being introduced Wednesday. The idea is to work both on a constitutional amendment and a state law, said Jones.

Grendell and Jones are trying to put the proposed constitutional amendment on the ballot by a vote of the legislature while Tea Party activists have started a campaign to get a similar amendment on the ballot by gathering signatures from registered voters.

“We’re advancing on all kinds of tracks,” Jones said.

Nice stunt and plays great to the minority base, but just who is left holding the bill when these Ohioans that support this “prohibit requiring individuals to obtain health insurance policies” go to the emergency room, or a doctor’s office or need any type of care from radiation treatment to setting a leg? Just who is it that this legislation declares as the payee of these unpaid bills from lack of any insurance policies? Will this not just make the Ohio uninsured paid for by the ones that now in Ohio have no insurance and are not made to carry some type of coverage? Wasn’t that the Tea Party’s problem before, to many uninsured being paid for by the rest of the insured? Just one more ridicules attempt at a law to do nothing but make less people pay for more freeloaders. To quote Rep Boehner, “Hell NO”.

The citizens of Ohio will have to pay more taxes to cover the increased medicare costs, from the losses in funding to pay for the federal bill. There will be more on medicare, new applicants, that drop off their insurance. Insurance premiums will go up for individuals, not counted in the CBO report, but a reality. Healthcare is a monster dead weight on the economy. There is nobody in Ohio who can’t get treated for a medical condition, and everyone knows this.

There is NO abortion funding, there is no illegal alien funding, Obama DID show a birth certificate. Don’t try to confuse being responsible with having health care. They are not the same. One shows responsibility when they take action to better themselves, not by expecting others to do it for them. There are jobs out there, they just won’t come looking for you. Get a job, get health insurance that is how it is supposed to work.

Or,do want them to be responsible and have insurance? If they choose not to take out insurance, or you so vehemently defend, then who pays in the case of a catastrophic accident? Who pays then Shane? Jim, what difference does it make if you say illegals won’t get hc and then pass a bill that legalizes them and then add these same people to the HC? It’s the same thing. He’s just bypassed or gone around the laws of the land. He’s changed our laws to be more in line with Socialism or Marxism. It’s funny that the dems want to call it a tax now but didn’t want to call it a tax when they were trying to pass this crappy bill. Funny in a “ends justifies the means” sort of way. But this tax being passed to all Americans is BECAUSE of REFUSAL of Americans to purchase an item being forced on us by an unconstitutional bill passed by the democrats without any bipartisan votes. This is so silly. One of two things is the case: Either the mandate to purchase insurance is constitutional, or it is not. The Supreme Court will ultimately decide that. If the mandate is constitutional, then it will override any state law such as this one. If the mandate is not constitutional, then it will be struck down whether or not this state law passes. So take your pick: This state-level legislation is either unnecessary or useless. Either way, it’s stupid.

Cheaper and quicker, but alas the democrats couldn’t steal more.” This would have been the smarter thing to do, but this admin doesn’t care about our economy—only that they are able to make it fail by taking over (nationalizing) HC, student loans, auto industry, banks, energy, legalizing illegals so they can get their votes, overwhelming our economy with handouts, entitlements, borrowing, printing of money. When it fails, they will be waiting with their socialistic agenda. They’ve been waiting for years for our govt to fail. They’ve had plans for our country. They couldn’t beat us on the battlefield, so they did it to us from within. They got a Marxist elected as Prez and he surrounded himself with Communist, Marxist, and Socialists radicals for czars and his administration. They used foul organizations like ACORN who didn’t care to use illegal means to get him elected including voter registration fraud/voter fraud. They gathered illegal campaign contributions by leaving off info that would have identified the contributor, in some cases these contributors weren’t American. He was illegally elected president and his fellow democrats, like Jennifer Brunner, refused to investigate the voter fraud (200,000 in Ohio alone). Gov Strickland stood behind Jennifer Brunner, so I blame both of them.

Squirreely, When this goes to court, the Justice Dept is going to argue that those who do not purchase health care will be “taxed”. The Federal Government has the right to tax, so this will be ruled constitutional. It’s very simple from a legal standpoint. All of these lawsuits are nothing but frivolous political theater and a waste of taxpayer’s money.

According to several articles, I have read on the lawsuit filed by different states attorney generals,legal experts said that federal law overrides state law. I don’t hear people complaining about paying taxes according to the state and federal law. Republicans across this country are sore losers and they will try everything they can to prevent small businesses from receiving tax cuts to pay for health insurance, millions of Americans with pre-existing conditions will continue to be denied coverage by insurance companies, and senior citizens won’t be able to pay for their prescriptions. I am NOT a Kool-Aid drinking Democrat nor am I on crack. I just know the facts of the bill. Maybe if our state representatives and senators who belong to the Republican party took the time to read the bill, I like have they would realize the benefits of the law instead of the negatives

Here is my comment to those of you that are comparing this to what Bush did…What he did was not unconstitutional!! He made a desicion to send troops and fight, and that is what he did. Oboma and his people have just spit in the face of the Constitution!! How can you call this a democracy and yet tell people that they have to use your insurance or else!! What about the fact that the government will now have full access to your bank accounts? Or the fact that not only do we have to pay for Americans to get coverage, but also all of the illegal immagrants here as well. I will do whatever I need to do to fight this!! Why isn’t our Attorney General joining the rest of them that are suing the gov’t for mandating HC? Thank God for Rep Jones. I’m barely making by now. I definitely can’t afford double premiums and higher taxes. I can’t wait until the administration is kicked out of the WH. I hope it’s before his term is up, he really should be impeached for overthrowing our govt. We weren’t a Socialist nation when Obama became President, but we are now. Obama has nationalized student loans and HC using IRS to enforce collections with this last bill. He already nationalized the auto industry and banks, and he’s getting ready to nationalize energy. He’s enrolling your children (through our schools and online) in his army and they will enforce the Social agenda if Obama stays in power another term.

so much has been made over this health care debate. why didn’t the republicans stand up and make this much noise when the bush administration was pouring billions of dollars into iraq. the secretary of transportation says it will take 600 billion dollars to repair or replace all of the structurally unsafe bridges in this country. the republicans never said a word about this but yet republicans scream when they have to shell out a few dollars for an american child’s health care.

Anyone know who is paying for the 32 million uninsured now? Insured people are paying for them. With 100 million working Americans, that means 1/3 of our current premiums are going to pay for health care for the uninsured. If you are paying your own health insurance premiums, you ARE paying for the uninsured too. I take it most of the loudest complainers are uninsured and want the rest of us to continue paying for their health care.

Regardless whether or not you support this issue we as americans have the right to choose what happens here i personally did not vote for this which is quite unnerving what is next? i support our local government in challenging this… before we become exactly what this country stood against for so long socialists

Isnt it great that Obama signed a bill into law that mandates health insurance for even registered sex offenders? Sex offenders now have an equal right to access date rape drugs and Viagra. The law also lets people get abortions on demand using tax payers money. NOBAMA 2012!

And Dems are so noble and righteous because BO was going to sign an Executive Order to prevent federal funds paying for abortions to buy Stupak’s vote. All knew it was not worth the paper it was writen on. It just added cover for the phony Dems, but they did not fool us. It was so phony, BO did not even sign it today.

OldTimer, The 10th Amendment to the US Constitution says that any and all powers not listed are reserved for the states and the people. So, If the US Government passes a law that doesn’t fall under their constitutional jurisdiction, and the states pass a law making that US law null and void, then it is perfectly legal and constitutional. That’s why our constitution was made the way it was, so that the local governments and the people have the most say. But hey, what do I know, I only studied Constitutional law

Old timer, I believe some states do obtain the right to have their laws supercede the federal government. I believe Texas and a few others are exempt of that rule.

Rest assured, this is Constitutional. the Federal Government absolutely has the authority to do this, unlike all of those other things I mentioned that the Government was doing (and probably still is, quite frankly.)

Businesses run like GM don’t deserve to be in business, who in their right mind ought to get paid 50 bucks an hour to pull a lever…..and now Obama wants to tell us how to run our businesses and our lives. Him and Pelosi are disgusting and need to go. I’m glad a 40 something year old president who’s never run anything and has a cabinet that 92% of them have only been in politics is going to tell us how to do things. Jones should contact Obama’s advisors, they can advise him on how to go around the system.

States cannot override federal laws be it through legislation or constitutional amendment. That was driven home by the Civil War. That’s why we have a federal government and not a confederacy.

these people that are so upset they want to change the Ohio constitution about this but not about the GM buyout, the Bank Bailout or two wars from Mr. Bush but now that someone is trying to fix something, and save money eventually, she wants to spend time trying to get the constitution changed. This is why we need to vote most of the people in office today, OUT.

IT does not appear that any of your crac-addled, nunahs out there really understand what the constitution is about. You do not put things like this as amendments for goodness sake. That is why laws were made - to allow us to uphold the meaning of the constitution.
