Judge’s ruling on federal health care law sparks contrasting reactions
A second federal judge ruled Monday that the requirement in the new federal health care law that Americans get insurance is unconstitutional.
Ohio is part of the lawsuit in Florida challenging the constitutionality of the law.
Ohio Attorney General Mike DeWine, who acted to make Ohio part of the lawsuit, praised the ruling while Brian Rothenberg, executive director of ProgressOhio, a liberal advocacy group, blasted it.
“This ruling confirms the alarming overreach made by the federal government and sends a clear message that the federal government cannot regulate commerce by forcing citizens into the marketplace to buy a product,” DeWine said in a press release.
“It is disappointing that Judge Roger Vinson, a conservative appointed judge, chose to legislate from the bench,” Rothenberg said in a release. Rothenberg called it a “political ploy” to “resurrect” a political debate that was resolved with passage of the bill.
The fate of the law ultimately is expected to be determined by the U.S. Supreme Court. Vinson’s ruling lets the law stay in effect while President Barack Obama’s administration appeals.
In December U.S. District Judge Henry Hudson in Virginia also ruled against the insurance requirement.,

Not true, Mike G. The latest CBS poll (and it’s in line with the other major non-partison polls) shows only 40% are in favor of last year’s health care reform. That’s up from the 38% that supported ObamaCare in early November—again, in line with other polls. 61% of Republicans, in early November, wanted the bill repealed. http://www.cbsnews.com/stories/2011/01/16/politics/main7251893.shtml Other polls prior to the election showed 57% of likely voters wanted to repeal health care. Obviously the economy was a factor in the elections. But, a large marjority of Republican voters believe ObamaCare has NEGATIVE ramifications on the economy. Polls throughout the fall showed independent voters views closely aligned with Republican views regarding ObamaCare and the economy. Yes, the Tea Party makes up just under 30% of voters, but over 60% of registered voters said last fall they share some or all of the beliefs held by the Tea Party. Many Tea Party voters cited our fiscal issues as a primary reason to vote. But, those same people also believe last year’s Health Care Reform will COST the U.S. money, not save money. The two (ObamaCare and the economy) are joined at the hip. After all, healthcare is 1/6 of our economy. After listening to Speaker Boehner the past couple of months I don’t believe they feel they have a mandate, like Obama did in early ‘09. Boehner keeps repeating they are going to listen to the American voter. Lets Hope so!

I say kill the mandate to stop this nonsense discussion. However since conservatives believe in personal responsibility, I say once you opt out there’s no back in. And there’s no declaring bankruptcy, if you end up with cancer and chose not to opt in, you will have to sell your house, land, everything if you want treatment. You will be personally responsible for your health.

Earl - Obama is not ignoring the judge, if you read correctly, the judge has allowed the law to stand while it gets appealed. Mike R - No, independents rallied behind Republicans due to the lack of job growth. Polls indicate half the country approves of HCR, and it’s a huge mistake by Tea Partiers to believe they have much power; Tea Partiers are only 30% of the electorate, hardly enough to make call themselves a majority, and the Republicans are making the same great mistake the Dems did back in ‘09; thinking that winning seats was an approval of their whole platform. Basically it was the economy, st%pid!

Regarding Healthcare Reform, WE WILL NEVER HAVE REFORM AS LONG AS SOME PEOPLE HAVE TO PAY FOR THEIR HEALTHCARE & SOME PEOPLE GET IT FOR FREE. UNTIL IT’S FREE FOR EVERYONE FAIRLY, THEN IT WILL SURELY FAIL.

welcome back republicans. What happened to focusing on job creation?! This law will stand. The argument is over the mandate part of it. We’ll see if that stands the legality test. I think it will. The government requires us all to get an education by mandate for the greater good of society. Is that unconstitutional? Its one of those grey areas where it might stand if it is for a proven societal benefit. I hope it stands.

All, true Earl, but those examples you cited may pale in comparison to his naivety in world affairs. Reports this afternoon show he directed the U.S. gov’t to hold secret talks with the Muslim Brotherhood and the subsequent downfall of Egypt. It is an Islamist group that does NOT respect the peace treaty between Israel and Egypt. If that happens Oil could easily spike to $150/bbl. Isn’t that what Obama wants? Has he not spoke about driving up the costs of energy to make “green” energy take root? I have a feeling the method to his madness will backfire. Israel will have nothing to do with it…Short term spike in Oil while Isreal secures its future.

The Obama administration has stated that it plans to move forward with its implementation of Obama-Care. This is in direct opposition to the ruling of U.S. District Court Judge Roger Vinson. This isn’t the first time Obama has ignored a court ruling and continued doing as he pleased. Remember the moratorium on oil drilling in the gulf that was struck down by U.S. District Court Judge Martin L. C. Feldman. Obama just wrote a new moratorium and extended it to seven years instead of the original six month period. I could just imagine Barack saying,”The heck with you and all your dirty oil friends and the economy in the southern states… I’m doing whatever I damn well please.” This is the man the ill informed have elected into office. I suspect the court won’t find Barack in contempt, but a growing number of Americans sure do.

It’s always funny to read the comparisons of requiring auto insurance to health insurance. It’s not complex at all and should be easy to comprehend, by most. The gov’t does not mandate you to buy a car! The mandate cannot be ammended without destroying the whole bill. When the Dems wrote the bill they structured the bill without any severability clause to the mandate. The majority of states, 26 in all, joined the suit, paul, that should tell you something right there! This is HOW the Republicans won back seats! They promised the voter they would do this if elected—On Nov. 2, 2010 the citizens in Ohio and across the country rallied behind Republican/Tea Party candidates in part to repeal ObamaCare.

When most Americans recognized ObamaCare was unconstitutional to begin with… what does it say when we hear Democrats like Chuck Schumer claiming “the 3 branches of government are House, Senate and President??!” HAHAHA. ObamaCare is the biggest farce, ever. Just the fact that Democrats actually believe you can cover 30 Million more people.. without even attempting to significantly reduce healthcare costs first—is totally irresponsible and incompetent. Most people realize there are much better ways to reform healthcare/insurance/ reduce healthcare costs. (without more regulations, taxes and taking over student loans!).

Obamacare is simply another government entitlement program. It does NOTHING to control/reduce the cost of healthcare in this country—and Obama and the left know this… In this case it’s good to know the judicial system has provided a system of “checks & balances” to the legislative side of our government— just like it is designed to do…

I will chalk this article under WHO CARES! If the mandate portion of the Healthcare law is the problem then it should be admended. This seems like a simple issue to me. If the mandatory component of this law is what is unconstitutional then there is no way that the obligation to carry car insurance is constitutional! I refuse to believe this any differently. Although my neighbor tries to convince me after he listens to Sean Limbaugh or Glen Hannity or Rush Beck! I am way too smart for that. Hey since we have a Republican Gov, how about he go down to Memphis and steal Fedex the same way the Republican Gov. came to Ohio and stole NCR! I mean we do have Mike Turner and Big Speaker on our side!

This is not only a waste of time but its being done purely for poltical reasons, nothing more. Funny how the repubs win back the house and this is how they have decided to waste our money, of course in addition to increasing the deficit by forcing the tax cuts for those that dont need it. Just more of the same political grand standing by wind bags full of hot air inciting the dumbed down faux noise sheeple. Kasich, Boehner, Portman, DeWine, not a public servant in the lot. All I can say is they are disgusting just as those are that would put them in power.

Brian Rothenberg needs to re-enter grade school to learn about the purpose of federal government and the basics of the Constitution and individual liberty. He also needs to understand that just because the legislative branch passes a law doesn’t mean it is legal.

If congress is not limited by the enumerated powers granted them in the constitution, then they are free to do anything, and the constitution means nothing. The illogic of Rothenberg is pitifully comical. In what country does he think he lives?
