Senate effort to repeal health care law fails; Ohio senators speak out

By Jack Torry Washington Bureau

WASHINGTON - With Senate Democrats Wednesday night blocking GOP efforts to repeal last year’s health care law, congressional Republicans hope to push through a wave of smaller bills as a way to slowly pick apart the key sections of the law.

By a vote of 51-47, the Republicans fell 13 votes of killing the law, which is the signature domestic achievement of President Barack Obama’s first two years in office. It provides insurance to 32 million people currently without coverage.

Sen. Rob Portman of Ohio joined 46 other Republicans in voting to scrap the law, while Sen. Sherrod Brown of Ohio, 49 other Senate Democrats and independent Bernie Sanders of Vermont voted to retain it.

Because the non-partisan Congressional Budget Office projects that the bill would save $230 billion over the next decade, Senate rules required 60 votes to repeal the law. Republicans have dismissed the budget saving projections as unrealistic.

Despite the vote, the law remains under fierce assault in the courts and by the Republican-controlled U.S. House, which voted last month to repeal the measure.

A federal judge in Florida this week invalidated the entire law, while a federal judge in Virginia in December struck down the law’s requirement that Americans buy insurance or face financial penalties. But last year, two other federal judges ruled the law was constitutional, setting up an all but certain road to the U.S. Supreme Court to determine the fate of the law.

Moments after the Senate vote, House Speaker John Boehner, R-West Chester Twp., said that “this debate has just begun.’’ In a statement, he said “the need for repeal continues to become more clear, whether it’s in the courts or the court of public opinion.’’

Boehner vowed to “continue working to repeal this job-destroying health care law and replace it with common sense reforms that lower costs and increase access without putting more Americans out of work.’’

Adopting a more conciliatory stance, Portman expressed the hope that the combination of the repeal votes in both houses along with this week’s court ruling “would bring people together’’ in both parties to “figure out how we take this legislation and change it.’’

“I am so concerned about the way this law is affecting our economy that I’m hoping in any and all ways to improve it,’’ Portman told Ohio reporters in a conference call after the vote. In the House, the tax-writing Ways and Means Committee hopes to round up the votes to kill the individual mandate and scrap the independent payment advisory board, which is supposed to suggest ways to limit spending on Medicare, which covers health costs for the elderly. But any Republican effort to dramatically revise the law would meet with intense opposition from Obama.

In a Senate floor speech Tuesday evening, Brown complained that Republicans “don’t really want to fix” the law because “they have offered nothing to fix it.’’

He castigated Republican calls to allow insurance companies to sell insurance across state lines and to curb expensive lawsuits against physicians and medical providers, saying “that might insure 2 million or 3 million more people … nothing substantive that matters in people’s lives.’’

ByWhat?—At least you got a portion back from that company across state lines. What do you think you’ll get if you have to fight with the Federal government? Sue the Federal government? What a laugh. You think the Federal government is looking out for YOUR better interests? When a shortfall of money happens for your healthcare, our government will then make the decision as to whether or not you will get life saving medicine or surgery. These government people making those life and death decisions on your life are what are referred to as “death panels” and is provided for in Obama’s hc fiasco bill, they just don’t use the term “death panels” but it is the same thing. Try arguing with the govt when you are sick and need surgery. Good luck with that one, especially if your political party doesn’t match your doctor’s or your president’s! Did you know there are HUNDREDS of waiver requests from companies like McDonalds that won’t be required to adhere to Obama’s hc “penalty fees” or “taxes” or whatever he’s calling them now (this is why the hc bill is considered a job killing bill, because companies won’t hire people and will even lay people off because they can’t afford these extra penalty fees). However, Obama made sure that his hc fiasco bill provides for an ARMY of IRS agents that will be hired just to make sure you pay those penalty fees to the Federal government. At least Obama covered the government’s behind, but forget yours! And as a premium, we taxpayers can pay for abortions since they are covered in the hc fiasco bill, but remember, when it comes to life saving surgery or medicine, forget it. You will be judged on your worth according to your age, the very young and the older people are not “worth” as much, and your medical treatment will be based on that. Nice, huh?

A college education and free health care are a right? How about increasing how big our partner’s big thumb is and our right to be a superstar? HuH? So this fiasco hc bill increases everyone’s hc premiums and raises hc costs, and it increases the number of patients doctors have to see, and it makes us pay for abortion (baby killing) and makes states pay for start up costs we can’t afford. So you want to look like Greece, riots and all? Is that what you want? How about we get some adults in charge who WEREN’T part of those communist groups who have been trying to bring down our Republic? Maybe we should switch up those who are czars, like our manufacturing czar who actually believe in free enterprise? Does Obama have anyone in his administration that didn’t bomb a police statioon or doesn’t want to forcibly and secretly sterilize our water system? I’m just sayin… Does he have anybody in Homeland Security that is working on securing our borders, or are they all worried about how much salt we Americans are allowed to put on our food? Huh? HC costs? What can a community organizer do to assure that insurance is available for people without insurance? Let’s see, first he takes down our hc system and inserts an army of IRS agents…nice move, Dictator Obama!

Morning, Mike R. Thanks for correcting me on that. It does however appear that healthcare and social security shortfalls are time bombs that we need to reorganize for a stable economy/populace. Everyone that I know needs both. It’s interesting that in terms of reorganizing healthcare we do have the benefit of seeing what other nations have tried and what might work for us. Eg. Canada, Britain and Germany. No one wants to lose quality/access, but there is no problem with regulating private industry and requiring a minimum of coverage for everyone. Obama is far from radical. I would really like to see ss guaranteed for everyone, especially since I have paid into it and I will need it when it is scheduled to run out. “borrowing” money from h/c and ss funds should be illegal. Why do conservatives have such low expectations? Don’t let politicians get away with that. It’s your government. If you want to reduce infant mortality, improve education and quality of life.

Federal law requires everyone to be in Social Security Insurance or a state supervisied pension equivalent. Turned out to be great program, the most popular, lowest cost to administer, most copied program in the history of the world. Key word here is “insurance” as in FICA deduction.

WOW!! Did Martin and Ellen have a Jewish wine tasting event for all the liberals tonight? Scoobydoo, you wrote your comment like Charlie Sheen speaks in real life—Not a Two and a Half Men episode. Maybe Senator Brown should require devices from drunks typing on Keyboards. Oh, wait, Martin won’t opine favorably for that bill. He’ll just sip his wine quietly. Jerry: HA HA HA! LOL. Required to buy electricity, eh? Are you penalizied by the Gov’t if you don’t pay your DP&L bill?? NO! I’m not sure what Marty and Ellen told you at their party, but your story about FDR and the TVA ain’t even close to being the truth. Next time you go to one of their wine drinking events, just remember, they aren’t motivated by the truth.

ObamaCare: 2700 page Monstrosity that handed-over 30 Million new customers to the insurance companies! (Not a smart move, at all). Takes-over student loans (does anyone know what that has to do with healthcare/insurance?Mandates that everyone buys insurance; But does it solve the #1 problem: Skyrocketing Costs. Absolutely not. Top Medicare official testified that ObamaCare probably Will Not reduce healthcare costs. ObamaCare is an albatross for Democrats. Just wait.

Well let us face it the bill is needed to protect from greed and waste. I find it historically accurate to remember that FDR’s administration was under fire about the TVA and the government forcing citizens to purchase electricity. The courts struck down most of the bill and now electric is government sponsored good and bad. The problem then, was that private companies could not compete. Well let us face it health care would be no different. Regulation is needed to protect our citizens—not saying a long term solution just in the short run. As far as government spending and cutting it. The domestic spending is the least of our worries. I would start with two wars that are going no where. The region we tried to protect is just as unstable as when we decided to attempt to clean it up.

Thanks to Senator Brown for sticking up for whats right. Where are all this GOP/conservatives with THEIR gov supplied health care? I do not see McConnell giving up his health care, he is to busy taking your away. Brown was the only one that up top this Jan was NOT taking his health care from the gov. Where are all the teapots yelling and screaming about the hypocrites that they elected that are now on the government health care system? Heres an idea for the conservatives, you get ride of your health care first then lets work on mine, but YOU first!

WC, it says the persuit of happiness. By definition, it says there are no guarantees, just the govt will not get in your way. You say you have a right to healthcare without going bankrupt. Do you beleive you have a right to healthcare if it bankrupts others? Reality says someone, somewhere, sometime has to pay for it. What do you mean it will only kills jobs for Republicans. Get real. WC, the God given right to life, liberty, and the pursuit of happiness does not give you the right to enslave another person. Unless you can provide yourself with health care you do not have a right to health care. Health care is a service provided by another individual and that person has the right to life, liberty and the pursuit of happiness as well. We ended slavery in America long ago.

To Leslie As a so-called liberal I will explain. I have the right to life liberty and te pursuit of happiness. You madam need to read the constitution you no doubt want us to live by. I have the right to get healthcare without going bankrupt. The health savings plan will not work for most of us because we will never be able to save enough in case we get sick. Social Security and medicaid are important and need notd be messed with because of my right to live. Wake up America. Let’s fix it not kill it. It will only kill jobs in the insurance industry. And it will kill jobs for the Repubs because when it works we will vote them out because of the non-caring mentality the express.

The Democrats turned into the Party Of NO yesterday. They all voted in lockstep against the opportunity to fix the problems in the Obama Healthcare Takeover. The Republicans kept putting up bills last year that the DEMS wouldn’t allow to even come up on the floor for discussion. Then the DEMS would say the Republicans hadn’t offered anything. On this, Obama hasn’t done anything to lower cost of insurance or cost of medicare care. He has raised it with a 3% tax on medical equipment and by having the few working people pay for more people’s healthcare who aren’t working, never have and never will along with lots of illegals that the DEMS want here to vote. When will the DEMS tell the truth about what they do? Brown in Cleveland is as far removed from the people of Ohio as he could be. We are going to be innundated with pictures and quotes and articles about him by the media til 2012 for his reelection. Let’s vote HIM and Obama OUT.

lets draft legislation saying… 1.Any company that recieves tax payer substidies/tax breaks and provides employer based H.C. will not longer recieve them if they continue to provide HC to their employees. Public or private sector. No write-offs anymore. Its now all on the EMPLOYEES and money out of THEIR POCKET I would love to see all the republicans/baby boomers try to fend for themselves. Especially those who have retired w/ GOLDEN HC plans that are “high risk” or have pre-existing conditions that RUN MY HEALTH INSURANCE COSTS UP! 2.Eliminate ALL federal/state money to hopitals who treat the sick and dying w/ no proof or means to pay.So if you get wheeled in and can’t provide proof upon arrival the plug is pulled/your turned away no matter your condition/state of being. If a hospital believes its their MORAL obligation to treat, thats fine, but the money goes bye bye. These two plans would reduce costs and put an end to those who recieve free health care on the backs of the rest of us. 3.Since the HC bill is socialist…end Medicare/Medicade/S.S. as well. These are the largets SOCIALIZED programs we have. Once again, I would love to see the republicans/baby boomers who think the HC bill as socialized medicine shake in their boots. The MANDATE is a REPUBLICAN idea! First introduced by Nixion when he wanted to MANDATE that ALL employers provide HC to their employees. Second when the republicans introduced it to rebuttle “Billary Care” and a single payer system in the 1990’s. No REPUBLICANS had a problem w/ the mandate then. The current HC bill is not gvt. ran insurance. If it were it would be a SINGLE PAYER SYSYTEM. Even a PUBLIC OPTION would not be a gvt. ran insurance. The mandate insures NO BODY gets a FREE RIDE anymore.

Hippocratic Oath. Original, translated into English:[4] “I swear by Apollo, the healer, Asclepius, Hygieia, and Panacea, and I take to witness all the gods, all the goddesses, to keep according to my ability and my judgment, the following Oath and agreement: To consider dear to me, as my parents, him who taught me this art; to live in common with him and, if necessary, to share my goods with him; To look upon his children as my own brothers, to teach them this art. I will prescribe regimens for the good of my patients according to my ability and my judgment and never do harm to anyone. I will not give a lethal drug to anyone if I am asked, nor will I advise such a plan; and similarly I will not give a woman a pessary to cause an abortion. But I will preserve the purity of my life and my arts. I will not cut for stone, even for patients in whom the disease is manifest; I will leave this operation to be performed by practitioners, specialists in this art. In every house where I come I will enter only for the good of my patients, keeping myself far from all intentional ill-doing and all seduction and especially from the pleasures of love with women or with men, be they free or slaves. All that may come to my knowledge in the exercise of my profession or in daily commerce with men, which ought not to be spread abroad, I will keep secret and will never reveal. If I keep this oath faithfully, may I enjoy my life and practice my art, respected by all men and in all times; but if I swerve from it or violate it, may the reverse be my lot. ”

The idea that the government has this much power is inconsistent with the fundamental idea that underlies the theory of rights in the Declaration of Independence - the idea that we own ourselves and, therefore, have the right to be left alone as long as we honor the equal right of others to be left alone. If the government can prohibit inactivity by forcing you to purchase health insurance or join a health club, you really don’t have any sphere of self-ownership or autonomy and are completely at the mercy of the government. So before you accept the idea of the Obamacare individual mandate, keep in mind what it really means: an unprecedented expansion of federal power based on a concept of rights that is inconsistent with our founding principles.

Glad to see a few of the DDN posters understand what is really happening. On the other hand, it’s sad to see all the misinformed, naive, and quite frankly stupid people who choose to live in a wonder land of intentionally misleading talking points,rah-rah speeches, creative accounting, outlight lies, and the manipulation of, and self serving picking and choosing of existing law. Hundreds of companies and unions, mostly those who have financially supported Obama have opted out of the health care plan. If Obamacare is so great, or even remotely close to what Obama claims it is, why are they so eager to opt out? Why are they permitted to opt out? what do you have to do to be allowed to opt out? Google the list, it may open your eyes. Obama, the self proclaimed leader of the less fortunate and downtrodden, takes over GM, screws the workers and taxpayers opens his new green plant in Mexico, and now his shady dealings with GE,(who by they way has lost thousands of American jobs in the past 2+ yrs) who also has opted out of Obamacare, and just opted out of Obama’s Global Warming $$ grab. DDN chooses to gloss over the significance of yesterday’s ruling, but we know this is just the beginning.

When the Arkansas company tried to cheat me, the only recourse was to file a complaint with the FTC, who does nothing, then go through the Ohio Attorney General, who had no power over them. I had to initiate a law suit and get the Ohio AG involved over 6 months to get a portion of my money back. Part of the problem (from an NPR article): “…Japan sets the price they pay for MRIs super low. And so to get into the Japanese market, the manufacturers lower their prices. They charge more here in the U.S. because we will pay more. How come? Well, I called a number of American hospitals and doctors and I got basically two reactions. The first and most popular: a shrug. We could never get those prices. That’s just how it is. And the second: some were surprised….” The same happens with the price of drugs, we pay more here because the manufacturers can, so in reality we are subsidizing the cost of healthcare around the world with our high costs which pay for the R&D budgets of these companies.

I am always perplexed by this part of the health care debate. Do parts of this law need to go. YES! Keep the part that allows parents to keep childred on policies until age 26. I am always confused that almost no one looks at the other side of the equation. That is salaries and perks given to doctors. It is pretty common for most specialists to earn over $1 millon dollars a year and despite all the drame over trial lawyers, most doctors make obscense amounts of money. This does not count “royalties” and other off payroll revenue that doctors receive, including the fact that hospitals are owned by doctors. The AMA through congress keeps the number of doctors low. This debate should include insurance companies (all should be non-profits), lawyers, AND DOCTORS. For proof, walk by the doctors parking lot the next time you have an appointment or swing by the “doctors only” dining room where they receive free luxury meals.

The main problem is that insurance companies were able to convince congress to grant them an exemption to anti trust laws. Only they and baseball have complete exemption. The NFL has limited exemption. Here’s the problem. There are over 1800 companies that sell health insurance in the US. In Ohio only 5 companies can write coverage. This is the same thing as if in Indy only 5 dealerships could do business. If the exemption was revoked, competition would drive down premiums and co-pays. It would bring in increased coverages and offer more choices and combination of packages. You’d see companies forced to provide better service or go out of business. The only mandates needed might be to cover preexisting conditions, dropping people in the middle of sickness. I suspect that even some of these might be resolved by competition. It has taken some time but finally some of the democrats are also now realizing that this is one of the biggest reasons why the companies can do to us what they’ve done…. And lastly the congress should have exactly what they people have..

I am pleased with the courts for doing the right thing against the healthcare bill. The House and Speaker Boehner are also doing the right thing against the opposition of Obama and party. The healthcare bill is socialist, involving too much govt. control and mandate. The govt. is out of line telling the individual they HAVE to purchase healthcare insurance. Just a step toward greater control of all of us. They MUST be stopped!

I think the President’s own words are what will sink him. He knows mandates like this aren’t constitutional. He’s hoping to create change because his neck is in the noose. If they would remove the anti trust protection from insurance companies 85% of the problem would be solved.

I wish more politicians had the courage to do what is Right. Stand up to the insurance companies, and replace the insurance mandate with a public option.

This health care bill is only and all about the “takers” (47% of the population who pays no taxwes) making the producers (businesses and the remaining 53%) pay their way thru life. The Dems have and continue to divide this country by class. To the 3xLiberal you may think health care is a basic human right but theirs nothing right about making others pay for it. Liberals need to learn, teach and practice individual responsibility. This is all baloney anyways since Health Care will be defunded by the normal thinking responsible Americans that now are in the majority in the House of Reps. In case you Libs didn’t notice - you and your ideas were repudiated in the last election. Ha Ha Ha Ha Ha Ha

Health care is a human right. If you do not want universal health care for your fellow Americans, maybe you should reconsider your citizenship.

Let me tell you one thing that the best health insurance plans has completely different set of meaning for different type of people. For those who are rich, the plan which can earn them more is best. However, those who are in the middle class have different ideas. They think that insurance plan is the best for which they will have to pay minimum premium. However, the poor person does not even know that what is health insurance? If you are one of them search online for “Wise Health Insurance” and get smart about insurance.

Thought the republicans were going to address jobs? Instead they want to take away health care to people!

We all should remember this vote was never expected to pass only show Americans who’s side everyone is on. I am upset that the Republicans did not offer a substitute to Obamacare when putting this up for a vote. Alot of wasted time for an I told you! We all have to remember that Obama would of used his veto power to block the repeal, Obamacare will be settled by the courts not congress!

SOS, because Brown doesn’t think of Ohioans first. Nor does he think. He takes marching orders. It was in Obama’s State of the Union that shed light on this subject—For Dems—The IRS 1099 form that needed to be filled out for every purchase of $600 or more. Last fall Sherrod Brown voted “NAY” to repeal that part. For the exact same bill he voted “YEA” today. It was only after his boss Barry told him how to vote is why it is fixed.

If The legislation is flawed and requires a Republican fix, why did Sherod Brown push for approval without acknowledging that it would later need to be fixed?

KAF, Jim, Ohiovoter: What the DDN has oppressed in their reporting (thru 11:30 PM) is the fact that part of ObamaCare actually was REPEALED today. Anthony Shoemaker intentionally left this out of his report (or did the people at Cox Media censor his report?), but all other mainstream and credible outlets are also reporting the vote that took place prior to this vote. Brown voted in FAVOR of the repeal. The vote was 81-17 in favor repealing part of the health care bill. This was the exact same vote Brown voted against last fall, but voted “yea” today. You, and all of Brown supporters, including Mr. Shoemaker and the DDN, need to ask a fundamental question: What has changed between last fall’s failed vote and today’s vote to repeal part of ObamaCare. If you guys truly want to be informed you should insist the DDN stop oppressing news. http://www.politico.com/news/stories/0211/48726.html

I applauded the Democratic party along with Senator Brown for standing tough against the American. I called Sherrod Brown’s office in D.C. informing his staff that I wanted him to vote against the repeal. A couple of weeks ago I received a letter from my health insurance company informing me of the benefits of the new health insurance law. Boehner,Portman, and the rest of the Republican party is on the side of the rich, big companies, and the lobbyists.

Senator Brown should be commended for taking a stand. The Republicans support the rich and big business. President Obama said, lets work together and fix the parts of the bill that need fixing, and lets move forward. Instead, we get political theater from the Republicans, especially Mitch,”the turtle” McConnell. The Republicans don’t give a hoot about the middle class.
