Cafe Boulevard files for bankruptcy reorganization, will continue to operate

Cafe Boulevard, 329 E. Fifth St. in Dayton’s Oregon Historic District, is continuing to operate while the restaurant seeks to reorganize its debts under Chapter 11 bankruptcy.

Cafe Boulevard Ltd. filed for Chapter 11 bankruptcy earlier this month in the U.S. Bankruptcy Court Southern District in Dayton. It listed $56,000 in assets and $362,000 in debts. Chapter 11 bankruptcy allows for a company to reorganize its debt while remaining in business.

The restaurant’s owner and company president, Eva Christian, could not be reached today, April 22. Christian is out of the country and is scheduled to return later this week, said Cafe Boulevard’s executive chef, Rae Rosbough.

Donald F. Harker III, the Dayton attorney assigned to serve as the case attorney for Cafe Boulevard in the Chapter 11 proceedings, confirmed this afternoon, April 22, that the filing is a reorganization of the restaurant’s debts, not a liquidation.

“She hopes to be able to reorganize and to continue operations,” Harker said of Christian. “She, like many others in the restaurant business, hopes that this economy turns around quickly. It would be a shame to lose any more locally owned and operated restaurants in Dayton.”

Harker said Cafe Boulevard has 120 days — a deadline that can be extended — to file a detailed plan that would lead to the restaurant emerging from Chapter 11 bankruptcy. He said the restaurant, which has outdoor seating area popular in spring and summer, is entering a busy season, so he and Christian will have a better idea of the restaurant’s financial picture in mid-summer. The reorganization plan would be examined for feasibility by a bankruptcy court judge and would be voted on by creditors, Harker said.

Cafe Boulevard was open for business as usual Tuesday night, April 21. Rosbough siad the restaurant unveiled a new dinner menu last week, is planning on resuming lunch service on May 4 after closing for lunch over the winter and early spring, and is promoting a Mother’s Day brunch on May 10.

According to the bankruptcy filing, Cafe Boulevard owes about $138,000 in federal, state and city taxes and $224,000 to banks, vendors and other creditors. It lists personal property valued at $56,000, including $40,000 of restaurant equipment and supplies and $5,000 in liquor and food inventory. Its liquor license is valued in the bankruptcy documents at $10,000.

Cafe Boulevard’s gross sales dropped 12 percent last year, from $530,000 in 2007 to $465,000 in 2008, according to court records.

Christian also is founder of Cena Restaurant adjacent to the Dayton Mall at 2854 Miamisburg-Centerville Road. Nothing in the court records suggests that Cena is a part of the Cafe Boulevard bankruptcy filing.

A meeting of creditors is scheduled for May 22 in U.S. Bankruptcy Court in Dayton.

Cafe Boulevard…good riddance! Went there with group of 15 on New Year’s Eve only to be humiliated by the horrid service. Brought out appetizers when others were getting entrees, and then after entrees brought out salads. We made an early reservation so they weren’t busy. Then server dumps entire glass of red wine on my guests and did not apologize until I said something!! Then he offered to dry clean the shirt if my guest would kindly remove it. Complete morons. The food was okay, but service made us all so angry we have cursed it ever since. That next business day they charged me and several guests DOUBLE for our food. I had to call and complain to get them removed and was promised two free entree coupons. When me and my guests received the apology letters, they didn’t even enclose the coupons as stated in their letters! What a waste of space! Allow someone with clout to lease the space.

I work in advertising for the DDN and have no authority to remove editorial/on-line comments. Even if I did have this ability I wouldn’t do it for a myriad of ethical reasons. I reading these comments and I constantly see people saying the prices are to high - um, HELLO!!!!!!! The prices are cheap if you as me. I worked a quite a few places where the average price per person was $100. Dayton people are so lame - going to the cheesy chain restaurants and running their servers to death and then tipping next to nothing. That’s why I like working at high end restaurants so I don’t have to deal with all the cheap people that expect the world for under $20 bucks and then only tipping a few dollars!!!! Can’t wait to leave this city and get back to a REAL city. A city with cultured people that know good food and how to tip.

wow, I am really shocked how hateful some of you are. I am sure that none of you have ever owned a business, you would not talk this immature and stupid. have been a business owner for over 30 years and a chapter 11 doesn’t have anything to do with being shady…. in is just survival in this economy, she could have just closed the doors and put all employees on the street but she didn’t ! She is a hardworking individual…. even Donald Trump at some point had to file chapter 11….. and look where he is now

It is a common misconception that bankruptcy means the filer loses everything. In fact….a shady owner can suck money from a company…let debt accumulate…..misdirect funds easily….and then just throw up hands and say “bancruptcy.” Meanwhile, they have made or stored a boatload of money. This reeks of a great chef getting screwed by an irresponsible and egotistical owner. Sad. Face it folks…the meals were fabulous. Great food prepared DESPITE the influence of the owner….not BECAUSE of it. It’s the classic story of the primadonna, “I’m so great cuz I own a restuarant” type who doesn’t know squat about running a business. The place folds cuz the owner is an idiot….but the true talent of the joint, the chef, is the one who gets killed in the crossfire. I am an insider and I can tell you that Eva Christian has again proved to be on top of the game and has pre-planned. She did this because she cares about her staff who have been with her for many years, and she couldn’t stay open if she screwed local vendors. Delta has done the same and GM is about to do it, it is easy to close your doors but I am saluting her for her nature to fight thru this economy. We should support our locals more!!!!

Wow… I’m pretty impressed with all the financial experts that post comments on here. I’d be curious to learn how many restaurant owners there are of the people who have posted on here. Armchair quarterbacking is pretty easy and safe to do. Love her or hate her, she at least has the wherewithal to try. When anyone here has done what she has done, feel free to critic where she erred. Until then, send us your buiness plan so we can see how you are running your business.

Her vendors, if they had any brains at all, would have had “credit insurance” to cover their losses if she can’t pay. Most larger vendors do, and this is a service my GF sells, It’s called credit INSURANCE for a reason.

I am sorry another restaurant is doing bad in Dayton, but this has nothing to do with the economy! Eva has been in ligation over Cena ever since she had the delusional idea to open that style of restaurant. She has spent thousands upon thousands of dollars on a new house, restaurant, car , trips and bad choices on employees for Cena in the last few years and now it is catching up with her…can’t pass blame onto the economy for that.

I suport Eva and know she is doing the best she can! As someone who has worked for her I think she is a great person caught in an unfortunate sutuation…. But with her work ethic and strong will I think she will make it!!

Having worked for her, as well, I agree whole-heartedly with “Deserves”, and not “Scotti”. Karma can be a real kick in the bum. I wonder what time Eva is going to call DDN to have negative comments removed. She’s done it many times before, including last night. If she gave her employees half the respect that she desired, she may not be in this predicament.

Poor Scotti…I did work for her and watched her rip people off, time and time again (even her employees). I am sorry her employees may end up losing their jobs but if they are good at what they do, they will be picked up by another restaurant,and I know she is from Europe but that doesn’t excuse her from ruining a business that should be doing okay. I do believe she deserves everything people are saying about her. If she didn’t lie, cheat and steal so much (or at all), she wouldn’t have so many negative responses! I have NO sympathy for her all at!!

Eva is actually from Europe, so maybe she has a legit reason for being there atm. Family emergency? Kinda rude to just tear someone apart when you dont know the circumstances… As a person who worked for Eva for a long time, I know she is a hard worker who came here with a dream. How horrible that people who dont know her or her business would rather stomp all over it than support and try to encourage local business. I guess if it was another mediocre steakhouse at the mall… The restaurant biz is a very hard one to be successful in and racking up debt like that isn’t as hard as you would imagine.

How does the owner of this business afford international travel when she hasn’t paid her creditors or taxes? Closed for lunch winter AND spring? (2 of the 4 seasons?). The employees had better hope to God that none of the $138,000 in unpaid taxes are the employee’s personal withholding payroll taxes.

Cafe Boulevard is doing fine. Cena, which is a part of this bankruptcy, is what put Eva into bankruptcy. The Brazilian Churrasco is to narraw and expense for Dayton. It will only work in cities with large convention businesses like Chicago or Atlanta. Eva never paid her professionals and contractor for Cena and this is nothing more than a way for her to stiff local businessmen and blame it on the economy. Eva is very unethical and only cares about herself.

how does a company worth 50k get into 300k in debt. Sounds like horrible management. I live near the cafe, its rarely full, WAAAAY overpriced (for what you get) and atmosphere leaves something to be desired. I can see why this is happening.

Not Important, you might want to keep in mind that she owes $360,000 to companies that need their money. If she isn’t paying, her vendors will suffer greatly. I feel bad for her employees, but if she isn’t paying her bills her vendors will be forced to lay people off. Someone will be losing their job. She is a VERY shady person. If you are a vendor dealing with her, get your cash upon delivery!

This is not about an owner who you all seem to hate. This is about an economy that is crumbling here in Dayton. Instead of trashing people on a website, maybe you need to worry about yourself. I’m sure that there are a lot of good and decent people that work @ Cafe’ Boulevard. It would be a shame to lose another 10-20 jobs here in Dayton.

When I purchased my $50 of gift certificates for only $25 through channel 7, it was made clear that these could only be used one at a time. Which we’ve used twice since the new menu came out…YUM! It’s one of our favorite dining spots. Hope everything works out in the end.

Ate there several times…either had good food/bad service or bad food/good service. Never good food/good service. Who only lets you use gift certificates $10 at a time…it is already cash in their pocket. Rip off!

I hope they stay open. My GF and I like their food and dine there occasionally. She gave me $50. in gift certs for Xmas but you can only use them $10. at a time !? Go figure…Hope they will still honor them. At $10. a pop…
