Dayton restaurant owner settles sexual harassment lawsuit filed by former server
DAYTON — The owner of the Amber Rose restaurant in Dayton has settled a sexual harassment lawsuit that was filed by a Kettering woman who had worked as a server at the restaurant.
The server, Tawny Watkins of Kettering, claimed in the lawsuit filed in August 2010 in Montgomery County Common Pleas Court that Amber Rose owner Joseph Castellano made sexually suggestive comments and hugged, kissed and grabbed her on various occasions between Jan. 1, 2009 until she resigned June 18, 2010. At the time the lawsuit was filed, Castellano’s attorney — Tom Czechowski of Dayton — strongly denied the allegations. The lawsuit sought damages in excess of $25,000.
Court records show the settlement was reached and the case was dismissed earlier this month. Both Czechowski and Watkins’ attorney, Lucas Wilder of Dayton, declined to comment in detail this morning, citing a confidentiality agreement that was part of the settlement.
“A settlement was reached that was to the mutual satisfaction of both parties,” Czechowski said.
