Scott BlauveltHAMILTON — The Hamilton assistant city prosecutor fired in 2006 for allegedly walking around the Government Services Center naked has received a court decision that may lead to him returning to that position.
Scott Blauvelt, 36, was charged with two counts of public indecency in September 2006 after security cameras in the government building shared by the city and county allegedly captured video of him walking naked on two occasions.
The charges were dismissed on a technicality, but the city dismissed Blauvelt, claiming he was an unclassified employee. However, visiting Judge Thomas C. Nurre ruled on June 25 that the city's charter mandates that Blauvelt's position is classified civil service one.
Blauvelt's attorney, Michael T. Gmoser, said today that the ruling entitles him to a hearing from the Hamilton Civil Service Commission about whether his discharge was appropriate. However, Gmoser said the city has 30 days to appeal the decision.
