No jail time for minor league pitcher in brawl

A judge has waived a 30-day jail sentence for a minor league pitcher convicted of throwing a baseball into the stands that injured a fan during an on-field melee in Ohio two years ago.

Julio Castillo (HOO'-lee-oh kas-TEE'-yo) was released from probation Wednesday on the condition that he leave the United States and not return for a minimum of three years.

Montgomery County Common Pleas Judge Connie Price also ordered Castillo, who is from the Dominican Republic, to pay court costs.

A motion filed by his attorney said Castillo wants to return home, where he would then be released by the Chicago Cubs organization.

Castillo was convicted of felonious assault. The ball he threw while with the Peoria Chiefs gave a fan a concussion during in a Class A game in Dayton.
