Jury awards $400,000 in negligence suit

TROY — A Miami County jury awarded a Troy teen $400,000 in a medical negligence case. Jurors returned the verdict Nov. 2 for Derek J. Stephenson of Troy and against Dr. Richard Plumb and Dr. Craig Critchley of Upper Valley Family Care Inc. of Troy.
Stephenson, his parents and brother sued the practice and several of its physicians in 2005 claiming they failed to diagnose Derek's cystic fibrosis from birth in 1991 until July 2003, despite the availability of tests for the condition. The jury agreed that physicians failed to comply with the standard of care in their treatment.
