Sex offender's lawyers challenging order to move

TROY — Attorneys for a Piqua man who was ordered to move from his residence to accommodate a state law are challenging the order.

The appeal for Edward Burge, 33, was filed Tuesday with Ohio's 2nd District Court of Appeals.
Judge Robert Lindeman of Miami County Common Pleas Court ruled this month that Burge would have 30 days to move from his apartment in Piqua on East Main Street because it is within 1,000 feet of the Piqua schools' Werz Field and Roosevelt Fieldhouse.
State law prohibits registered sex offenders from living within 1,000 feet of school property.
Prosecutors argued the apartment was within 1,000 feet when measured "as the crow flies." Burge's lawyers claimed the 1,000 feet must be measured following a reasonable, navigable path.
Burge was convicted in 2000 of sexual conduct involving a minor.
