Five sons of woman who died in nursing home fire file suit

XENIA — The five sons of a Greene County woman who died after she was burned at Greeneway Manor nursing home on Aug. 31 have sued the Greene County commissioners alleging wrongful death.
The sons of Katherine Brown, 79, and her estate filed the lawsuit Monday in county common pleas court.

Brown died Sept. 2, 2006, a day after workers found her ablaze in her wheelchair. The county paid $10,720 in fines to the Centers for Medicaid and Medicare Services after a recommendation by the Ohio Department of Health.
State inspectors found "immediate jeopardy existed" at the county nursing home because workers failed to take precautions in response to Brown's suicidal tendencies.
A special prosecutor found no "substantial lapse of due care" by staff and did not pursue criminal charges.
The lawsuit seeks $8,000 for funeral expenses and undetermined amounts for medical bills and pain, suffering and other losses to Brown's family.
