Boy, 10, denies guilt in rape

SPRINGFIELD — A 10-year-old boy who was arrested on a rape charge last week was arraigned in juvenile court Monday.

The boy denied delinquency — similar to a not-guilty plea in an adult case — and is scheduled to be back in court Jan. 25, said Clark County Assistant Prosecutor Andy Wilson.

The boy is accused of having sex with his 7-year-old half-sister, according to a sheriff's report.

"The arrest is just the beginning of a process of healing for this family," said Clark County Sheriff Gene Kelly.

H. Owen Ward, a psychologist who is not involved in the case but has counseled young sex offenders and victims, said in other cases in which children commit sex crimes, the causes and motives vary.

"In some cases there are abuse histories and they're perpetrating as they were once perpetrated against," he said.

Other children have acted out or expressed sexual activity they've witnessed, Ward said.

In some instances, Ward said "the context" creates the sexual abuse. "If two children are playing together sexually and one's younger and one's older, if a parent sees this, they make the allegation," he said.

Other factors can include personality disorders, he said.

The 10-year-old is being held in Clark County Juvenile Detention Center.

Wilson said he couldn't guess what sentence the boy could face if found guilty of the charge.

"It depends how the case unfolds," he said. "In juvenile cases, whatever the outcome, the goal is to ensure that the child is rehabilitated," he said.

Investigators allege the incident occurred between Dec. 21 and Dec. 25 at the home where both children lived.

For the last comment, I’m absolutely sure the mother and father are putting thier daughter into counseling and this will help this young girl to be able to overcome this, in do time. Healing for her is just as important as healing for their son and the entire family. They are working with therapists, all of them, and the community needs not to interfer any more. Childern Services has destroyed these two childerns furtures. HOPE YOUR PROUD OF YOURSELVES!

I have scanned through many of these comments. No one has mentioned the trauma the 7 year old must be going through. Until it is determined that a rape or other sexual imposition did not occur, he should not be returned to the home.Another family member or a foster home, yes. It shouldn’t have been put in the paper.But it does happen. Ask anyone who works in Child protective services.There was a comment from a trained therapist who did say children mimic some things they have had happen to them

I truely can not beleive how you the media and you of all people SHERIFF GENE KELLY have exploited this situation with these two childern and their family. DO YOU THINK by charging this 10 yr old w/ rape will stand up in the judicial system? How do you look at yourself each day? This child needs to be back home with his mother.A 10 year old child should not be locked up.This has made things A lot harder on him.He needs time to heal,he needs family counseling he needs all of us to pray for him.PLEASE GOD SET THIS CHILD FREE.let him go back to his family that loves him very much.HE IS A CHILD LET HIM GO HOME.THIS IS NOT GOING TO HELP HIM BY LOCKING HIM UP.

I am absolutely appalled by this going all through the media, you have reported it on the news you have put it in print, and you call it news. I love how you think you have the whole story and you rush it to the news but yet you certainly do not know all the facts, and yet you have destroyed these kids lives. How do you expect them to have any normalcy after this, dont you think what they have already been through is enough? Apparently not because I still hear about it. The news sickens me.

I believe as others have wrote, the paper has took this too far and should of never been published. The family itself is going through a lot of pain with this incident that has happened. I believe the paper has not got all there facts right about the situation, rape is such a high charge and that is not in this case, for people that is praying, i think that is the best thing you can do for the family and there situation and not bad mouth anyone. So please continue to pray for the family

as a mother and confidant let me asure you this entire family is going through hell. and i promise you for all those readers who do not know this family the media and the newspapers are crusifying their well being. i assure you one thing though this family and these children have the best weapon on their side and that is Jesus Christ. Ive prayed for this boy and girl and there family, HAVE YOU?

As a teacher of young children and a mother myself, I can honestly say…WHAT WERE YOU THINKING….exploiting this situation in the newspaper!!!!! These are little children, and, if indeed this was a sexual abuse situation, it should have been dealt with privately, quietly and in a family/counseling situation….NOT IN THE NEWSPAPER!!!!! How can the youth of America learn anything, if the media and law enforcement use a delicate situation that will scar innocent kids to get Swingfield attention

Wonder how many parents talked to their kids about this just to make sure that it is not happening to them, This is an eye opener to all parents, To make sure that they know who their kids are hanging out with and to also know about their parents. Maybe some things are picked up faster by some and not others

This should never have been reported in a newspaper. The police and the newspaper have shown very poor judgement. Disappointed in Springfield which was my home town is very great. I would have authorities look into who leaked this from the police, to the newspaper that printed it. The police and the newspaper have labeled 2 children that will have to live with it the rest of their lives. It could have been handled more professionally.

It stuff like this story being in the paper and this child being made to look like a criminal that made me leave Springfield. I cannot believe that this would even go to this level. This child will now be labeled for the rest of his life.

My thoughts and prayers are with both of these children. Case most certainly should have been delt with differently. They are both children that have been exploited. How sad!

Some good comments here that show alot of common sense. A ten year old does not commit “rape” against a 7 year old sibling. They engage in sexual experimentation or exploration and perhaps it gets out of hand. Are they actually alleging penetration? VERY DOUBTFUL. This case would have been better handled in a gentle, family counseling situation with an emphasis on understanding boundaries. The handcuffs and shackles used in youth jails are very real and the boy has been brutally punished.

I can’t believe that this appeared in the paper! Actually, I can because the local stories this paper chooses to print are usually ridiculous. Did anyone think about how this will affect these children. I don’t care if you didn’t “name” the child, Springfield and its surrounding area is small. Somebody will recognize this incident in print. If you are going to write a story on child abuse, then do that, but don’t use a devastating local incident involving a child to do so.

The newspaper’s staff is just as predatory as the many men and women sex abusers it writes about. The objective for the paper is profit at all costs. The papers’ greed wont allow children lives and self esteem to stand in the way of that end.

You have got to be kidding me! This warranted a spot in the paper? This should have been in the area news briefs at best. The comments from H.Owen Ward were nothing more than filler. If I was one of the advertisers in your paper I would be pulling my ad if this is the best you can do for local news. The quote that best applies here is “Newspapers are ads, the rest lies between the ads”!! This is your wake up call News-Sun….Get with the program. This is 7th grade writing at best!

I have went through this recently in another county and I wish they would have done more to investigate instead of saying the story was too fairy tale-ish. (coming from a 3 year old). And putting her right back into that enviroment. Our country needs to start praying for our children and watch over them better as parents. God be with both these children. Think of what this little girl is going to have to deal with the rest of her life. Believe me I know.

What has the media come to? There are many hardened criminals on the street.You and Sheriff Kelly need to refocus on the latter and not the investigation of a ten year old boy. Shame on you both. Do you not know that this will potentially ruin this boy’s life? Guilty until proven innocent seems to be our new ethos. Let’s put on trial our society that allows ten year olds access to violent obscene movies, tv and internet porn which infects them.
