COLUMBUS — House Speaker Jon Husted, R-Kettering, wants Attorney General Marc Dann to resign but Husted wants more information before the House considers impeaching the Democratic attorney general.

"I think there is a big difference between asking someone to resign and moving forward with the impeachment process," Husted said Tuesday, May 6. "What we do will set the standards for how anyone will be impeached in this state going forward and that is a serious constitutional question."

Husted said that's why he has asked state Rep. William Batchelder, R-Medina, a former state appeals court judge with more than 30 years experience as a legislator, to review and report back to him by the end of the week on the impeachment process, the merits of going forward and related issues.

No elected official has been impeached in Ohio since the early 1800s. The Ohio Constitution says an official "may be impeached for any misdemeanor in office."

Batchelder said that does not necessarily mean a criminal misdemeanor as defined by Ohio law but could be misbehavior as defined by the House, based on legal precedents.

House Minority Leader Joyce Beatty, D-Columbus, said she agreed with the review Batchelder is conducting and that two Democratic members of the House will assist him.

Impeachment of Dann, who's embroiled in a sexual harassment scandal in his office, would require a majority vote in the House. If impeached, the Senate would try him and conviction would require the vote of two-thirds of the members.
