Second brother admits theft from dead grandfather

TROY — One of two Piqua brothers who broke into their grandfather's house on Memorial Day, less than 12 hours after he died, called his behavior "childish" before pleading guilty Wednesday, July 23, in a Miami County court.
Timothy Roth, 24, waived a grand jury's consideration of allegations against him and pleaded guilty to two felony burglary charges. He was sentenced minutes later, at his request, to two years in prison.
His brother, Daniel Roth, 22, faces up to 18 months in prison when he is sentenced Aug. 25.
Daniel Roth pleaded guilty July 10 to felony receiving stolen property. His plea was part of a deal in which prosecutors agreed to not seek additional charges in the case.

"This is a childish act I shouldn't even be here today for," Timothy Roth told Judge Jeffrey Welbaum in county Common Pleas Court.
Piqua police said the brothers removed a window screen to get into their 72-year-old grandfather's house May 26. Police said the brothers gave different stories about who allegedly did what.
Jewelry and medication, including liquid morphine, were taken.
"It is very cold, very unusual and very disheartening when you see something like this happen," Tom Christy, deputy Piqua police chief, said following the brothers' arrests.
Defense lawyer Mark Fisher said a heroin problem probably led to the burglaries by Timothy Roth, one May 12 and the second on May 26.
The charge in the May 12 burglary came after Timothy Roth was accused of stealing jewelry from a Piqua residence.
The occupant allowed him and a child who was with him inside to use the bathroom, Bruce Jamison, also deputy police chief in Piqua, said Wednesday.
