Recount likely in Montgomery County judge race
Thursday, November 06, 2008
DAYTON — Montgomery County Common Pleas Judge Frances McGee appeared to have carved out a small margin of victory — small enough that a recount seems likely.
Both McGee and challenger Dennis Adkins said Thursday, Nov. 6, they expected a recount.
Final unofficial results showed McGee defeating Adkins by 528 votes out of more than 200,000 cast.
McGee's colleagues on the Common Pleas General Division, Mary Wiseman and Jeffrey Froelich, were both celebrating victories Thursday.
Wiseman, who was appointed to the bench in 2007, won re-election, defeating retired assistant U.S. Attorney Margaret Quinn by nearly 15,000 votes.
Froelich was elected to an open seat on the 2nd District Court of Appeals, defeating Greene County Common Pleas Court Magistrate George Reynolds.
Betty Smith, deputy director for the Montgomery County Board of Elections said that no decisions on recounts will be made until the official results are certified on Nov. 25. Recounts are automatically done when the victory margin is one half of one percent or less, Smith said.
The other factor that could influence the race will be the 11,000 provisional ballots still to be counted, Smith said.
The 528 votes represents .003 percent of the votes cast.
McGee said Thursday she was not concerned about either the provisional ballots or a recount.
"I think it will stay," McGee said. "There are other judges on the bench that have won by less than 1,000 votes."
Adkins said he was "disappointed, but I'm going to wait until all the votes are in."
