‘Complicated’ sexual misconduct claim about ex-teacher takes new turn

A two-month investigation into allegations of sexual misconduct involving a former Miamisburg Middle School teacher has been sent to prosecutors.

The Miami Twp. investigation that began in late May - when the female teacher was placed on paid administrative leave before resigning shortly thereafter – was sent to the Montgomery County Prosecutor’s Office earlier this month, police said Monday.

The investigation involves a “very complex fact pattern,” said Miami Twp. Capt. John Magill.

“Any time you have an offense that involves a juvenile and a public entity, those things are always going to be more complicated than say a person whose arrested for OVI,” Magill said.

The nine-year teaching veteran stepped down May 23 from her post at the school on Miamisburg Springboro Pike amid a Miami Twp. police report that alleged sexual battery, records show. This news organization is not using her name because she has not been charged.

The claim is believed to have involved an eighth-grade male, Miamisburg Superintendent David Vail has said.

Vail said he first became aware of the allegation just prior to the start of the last day of school for students. The central office and human resources became involved at that point, he said.

The district’s investigation, Vail said then, “did not allege any sexual conduct.” A police report lists “sexual offense” as the nature of the call and “sexual battery” as the description of the offense.

The teacher began working with the district in 2006, records show. While earning a bachelor’s degree, she taught at Neff Elementary from September to December 2006 after other two stints as a student teacher, one with Dayton Public Schools, Miamisburg records show.

She was hired full-time two years later at Wantz Middle School and an evaluation later that year indicates she was “a great addition to the staff.”
