Clark County mom of dead 6-week-old baby released, charge dropped

Charges against a Clark County mother jailed after her 6-week-old baby died have been dropped.

A felony charge of endangering children against 19-year-old Shania Delawder has been dismissed without prejudice at the request of the prosecutor, according to Clark County court records.

In the case involving felony charges of child endangering against Delawder, there was insufficient evidence to present to a grand jury, Clark County Prosecutor Andy Wilson said.

Investigators are still awaiting official autopsy reports to be released, Wilson said.

The prosecutor’s office dismissing Delawder’s case without prejudice means they can refile the charges or they can take the case directly to a grand jury in the future if more evidence is presented.

The baby, identified as Liam Lee Spencer, died Oct. 6 after he was found unresponsive in a room at the Drake Motel, 3200 E. National Road in Springfield Twp.

Delawder and the baby’s father, Brian Lee Spencer Jr., were arrested on child endangering charges the same day.

The charge against Brian Lee Spencer Jr. is still filed in the Clark County Municipal Court, according to court records. He pleaded not guilty to the charge last week and he remains booked in the Clark County Jail.

There’s enough evidence so far in the investigation against the father to take his case to a grand jury, Wilson said.
