Suspect in Ronnie Bowers to appear for court hearing today

A decision on whether a 17-year-old facing murder charges will be tried as an adult in the September fatal shooting of a Fairmont High School sophomore is expected to be delayed.

A ruling on the fate of Kylen Jamal Gregory's case will be made at a later date, although a scheduled hearing will go forward Friday on related issues, according to Montgomery County Juvenile Court Judge Anthony Capizzi's office.

UPDATE @ 12:22 p.m. (Feb. 7):

An amenability hearing is scheduled for April 7 for the 16-year-old accused in the shooting death of Ronnie Bowers following an altercation at AlterFest.

The hearing could be the final step in the process to potentially bound over the case against Kylen Gregory to adult court.

According to court documents, Judge Anthony Capizzi ruled there is probable cause that Gregory committed the crime on Sept. 4.

Capizzi has ordered a psychological evaluation of Gregory prior to the April 7 hearing.

A court ruling is expected today on whether a 16-year-old will face murder charges in adult court for the shooting death of a Fairmont High School junior.

Montgomery County Juvenile Court Judge Anthony Capizzi said he would file his decision this week about the case of Kylen Jamal Gregory.

Gregory faces two murder counts and related charges in the Sept. 4 the fatal shooting of 16-year-old Ronnie Bowers III, who died two days later in what was ruled Kettering’s first gun-related homicide since 2007.

Two teens testified this week as part of a plea deal that they were with Gregory on Willowdale Avenue that night shortly after leaving AlterFest when the defendant shot Bowers in the back of the head as the victim was driving away from a confrontation.The 17- and 15-year-olds who testified were given maximum sentences this week by Capizzi.

WHO GOT SUBPOENAED?: Prosecutors seeking to try Gregory as an adult issued 14 subpoenas last month in preparing for the hearing on their attempt to transfer the case. All three passengers in Bowers’ car were named as potential witnesses, as was the person the two teen defendants said was driving the car Gregory was in.The documents also list three members of the Gregory family, four members of the Kettering Police Department and three others. Aside from the two teens who said they were with Gregory, only three KPD members and Dr. Mary Goolsby of the county coroner’s office were called to testify.Gregory’s attorney, Ben Swift, did not call a witness.
