Dayton Flyer Sam Miller’s attorney: Jail video ‘not the whole story’

The attorney for Dayton Flyers forward Sam Miller says the basketball player accused of assault is “a good kid,” and asked the public to respect the criminal process.

Miller pleaded not guilty to a misdemeanor assault charge. His case will move forward at a newly scheduled Xenia Municipal Court pre-trial hearing set for Aug. 22.

“I ask people not to prejudge him simply based upon what they have seen perhaps on their computers or on videos,” said Miller’s attorney, Dennis Lieberman. “It’s not the whole story, and I’m asking people to be respectful of our process.”

Leiberman declined to expand upon his comments, saying he would not litigate the case through the media.

Miller is accused of assaulting a fellow inmate on Sunday, July 30, in the Greene County Jail after an initial arrest for disorderly conduct by intoxication and underage consumption at Caddy’s Taphouse in Beavercreek.

Miller still appears on the Dayton Flyers roster, and court documents also now list Miller’s address as a University of Dayton residence on the 200 block of Caldwell Street.

Prior, court documents listed Miller’s hometown address in Arlington, Va., as his address of record.

Many basketball players spend their summers at the apartment complex, and the location — near where the former Frank Z Chevrolet dealership stood — has been central to a host of incidents involving team members in recent years:
