Ex-DPS substitute used hotel for sex acts, police say

UPDATE @ 3:30 p.m. (Oct. 20):

Miamisburg police began investigating Kenneth Smith in February of this year, the same month he was terminated from his substitute teacher job.

“It was over the course of several months,” said Sgt. Jeff Muncy of Miamisburg police. “Throughout 2015 and until we found out about it in February 2016.”

Muncy said no other potential victims have come forward.

“(The victim) didn’t have a lot of money to buy things, his family didn’t have a lot of money and the teacher took advantage of that,” Muncy said.

Muncy said Smith admitted to the inappropriate sexual nature of the relationship. Police would like Smith to turn himself in.

“Anytime there’s a student-teacher relationship, that’s sexual battery because that teacher has some authority over that student. Just by the fact that student knows he’s a teacher,” Muncy said.

A former Dayton Public Schools substitute teacher is accused of having a sexual relationship with a student at the same district and police believe the alleged illicit sex acts happened in hotel rooms in Miamisburg, officials said.

Kenneth Smith Jr., 31, of Dayton, was indicted by a Montgomery County grand jury Wednesday and Miamisburg police said they became involved in the investigation, because Smith was purchasing hotel rooms on “multiple days” within the city.

Smith allegedly became friends with the teenage boy, who was 16 or 17-years-old at the time of the suspected offenses, and was buying the teen items in exchange for sexual favors, police said.

While the teen did not have Smith for any classes at Dayton Public Schools, prosecutors said Smith met the teen at a DPS track meet.

Dayton Public Schools officials said Smith was not an employee of the district, but instead was an employee of Parallel Education Division, the organization the district contracts with to obtain substitute teachers for classrooms. According to a district spokeswoman, Smith was terminated from Parallel last February and has not been a substitute teacher for Dayton Public this school year.

Police said it appears that Smith was grooming the teen to be able to exploit him for the sexual favors.

Smith has a warrant out for his arrest and he is due in court for his arraignment on Nov. 3.

INITIAL REPORT (Oct. 19):

A Montgomery County grand jury has indicted a Kenneth M. Smith Jr., 31, on charges related to paying a juvenile in exchange for sexual acts.

Smith Jr. is accused of having a sexual relationship with a 17-year-old student he reportedly met a track meet, according to court records.

Smith Jr. was a substitute teacher for Dayton Public Schools at the time, according to Greg Flannagan, spokesman for the Montgomery County Prosecutor’s Office.

Dayton Public Schools spokeswoman Jill Moberley said the man would not have been an employee of the district but a contracted substitute. The district is checking Smith Jr.’s status.

Smith Jr. was indicted on two counts of compelling prostitution (minor for hire) and single counts of soliciting a minor, pandering obscenity involving a minor and sexual battery.

This was a Miamisburg case that originated July 2015.

Smith Jr. is not in custody and a warrant has been issued for his arrest. He is to be arraigned in Montgomery County Common Pleas Court Nov. 3.
