Judge in New Miami speed camera case: More issues to be resolved

The New Miami speed camera case will not travel back to Butler County for a judge to finalize issues, a magistrate with the 12th District Court of Appeals has ruled.

The village had asked the appeals court to remand part of its appeal back to Judge Michael Oster so he can determine several important issues, like the exact amount the village owes speeders and how those payments will be made.

The judge indirectly ruled in February that New Miami is on the hook for at least $3 million it illegally fined speeders.

Magistrate Bennett Manning said things are more complicated than the 60-day remand window the village requested.

“The remaining issues set forth in the court’s April 4, 2017 entry were not intended to be and are probably not the only issues that have to be resolved,” Manning wrote. “Further, there is no accurate way to predict how long it will take to resolve these issues.”

The village’s previous speed camera program was deemed unconstitutional in 2014 and the case has been in both the 12th District and Ohio Supreme Court. The 12th District is currently deciding whether the village has sovereign immunity.
