Beavercreek jogger hit by car was in ‘no driving zone,’ police say

BEAVERCREEK — An accident report released this week by Beavercreek police says the jogger who was struck by an SUV and killed last month was in a marked no driving zone when she was hit.

Michelle Hale, 44, of 4213 Aley Drive, was hit early Aug. 24 while crossing Dayton-Xenia Road from the bike trail to Stedman Lane. She was struck in an “area of the roadway that was striped off for a no driving zone,” according to the accident report stamped “incomplete” by Beavercreek police.

Timothy C. Peters, 52, 1660 Grange Hall Road, was driving his Ford Escape at 40 mph when he struck Hale. An “improper lane change” was a contributing factor to the accident, the report said. There is no crosswalk at the intersection, which is under construction.

Peters declined comment Thursday, Sept. 17.

Peters was questioned at the scene, but has not been arrested or charged. Hale’s death was ruled an accident from multiple blunt force trauma by the Montgomery County coroner.

Beavercreek police Chief John Turner said the investigation continues and police will confer with Greene County Prosecutor Stephen K. Haller before deciding if charges should be filed.

Peters has faced citations for past moving violations. They include speeding in 1995 and 2006, failure to maintain reasonable control in 2005, reckless operation in 1998 and operating a vehicle intoxicated in 1996, according to records from Fairborn Municipal Court, which has jurisdiction over Beavercreek.

Alcohol is not suspected to be a cause of the accident, police said. Peters did provide a blood sample to officers — a standard procedure in fatal accidents.

Hale, who worked at Wright-Patterson Air Force Base, was training for the marathon to be run on the base this weekend. She is survived by her husband, two daughters and a grandson.
