XENIA — Kevin L. Miller, the Sugarcreek Twp. man charged with menacing and public indecency for allegedly harassing people while wearing a woman’s swimsuit, remains in jail after a Xenia Municipal Court hearing Monday, June 22.

Judge Michael K. Murry on Monday denied a request to change Miller’s bond from the original $10,000, but Miller’s attorney, David Phipps, said the judge is still awaiting more information.

Phipps said Miller, 41, has not had a formal mental health assessment since his arrest June 8.

Murry said in Monday’s hearing that he would release Miller to house arrest if a specific mental health monitoring option was identified. The possibility of using a GPS tracking device in that situation also was discussed.

Miller, 41, watched the hearing by video conference from jail. He faces five counts of public indecency and three counts of menacing, all misdemeanors.

The incidents occurred between June 2-8, mostly along Washington Mill Road and the Little Miami River.

Sugarcreek Twp. Sgt. Mark White said township police went to speak with Miller as a possible suspect on June 8 and found him wearing a green swimsuit.

“That pretty much told us we had the right guy,” White said.

Xenia Prosecutor Ron Lewis said Miller was charged with menacing because he chased two juveniles in one incident and swam into the Little Miami River after two women who were canoeing in another.

Lewis said the public indecency charges came because Miller partially exposed himself to some people while wearing the women’s swimsuit.

Miller is scheduled for a pretrial conference in the case on July 7, although Phipps said that schedule could change.
