TROY — A Piqua man convicted of sexual conduct with two boys under age 10 was sentenced Monday, Nov. 16, to life in prison with no parole eligibility for 10 years.
Brian Weaver, 29, pleaded no contest in September in Miami County Common Pleas Court to four felony rape charges. He was found guilty. He faced life in prison without parole eligibility for 30 years.
Prosecutors recommended concurrent sentences to the one life term as part of a plea deal.
Weaver was accused of molesting the boys, who he knew, between August 2004 and February.
The abuse was reported to Piqua police in March when one of the children told his mother about the conduct as she talked with him about inappropriate touching, police said.
“I’m sorry for what I’ve done, and will accept the sentence you give me,” Weaver told Judge Jeffrey Welbaum on Monday.
Weaver’s only prior record was a disorderly conduct conviction, the judge said.
If released from prison, Weaver will serve five years of post release control.
During that time, he will be prohibited from any contact with the victims and their immediate family. He was ordered to pay for all future counseling received by the victims.
Weaver was classified a Tier III sex offender. The designation will require him, on release, to register his address with the sheriff’s office where he lives, works or goes to school every 90 days for the rest of his life.
