TROY — The Miami County prosecutor filed a murder charge Tuesday, Aug. 3, against the father of Caleb Durig, the 8-month-old infant who died last week from multiple blunt force trauma.

Jason Durig, 29, was charged with one count of murder, a first-degree felony, in the Miami County Court of Common Pleas, said Gary Nasal, county prosecutor. “It was committed in the course of committing another felony, which was child endangering,” Nasal said.

Jason Durig also was charged Tuesday with new second-degree felony charge of child endangering, Nasal said. The previous, third-degree child endangering charge will be dismissed, he said.

The baby’s mother, Tara Durig, 27, was charged Tuesday with permitting child abuse, a first-degree felony. She also faces a pending charge of child endangering, a third-degree felony, Nasal said.

Jason and Tara Durig are both being held at Miami County jail.

Nasal expects the Durigs to be arraigned on the new charges at 1 p.m. Tuesday.

The Durigs called 911 on July 26 at 11:42 a.m. and said the boy was not breathing. Tara Durig told a dispatcher that the boy’s nose was full of blood. She also said that they had checked on the boy about 10:30 a.m. and he was fine.

But police at the scene said the boy had likely been dead at that time, noting “this was not what appeared to be a fresh death,” according to a police report.

There was blood on the floor around the baby and blood was splattered on the rail of his crib, according to an affidavit filed with a search warrant.
