DAYTON — One man was arrested and another escaped Thursday night, July 16, in the attempted robbery of a Kroger on South Smithville Road that involved an off-duty Dayton police officer firing a shot at one of the assailants, police said.

The officer, who was providing security for the store at 1024 S. Smithville Road, fired once at the two robbers who walked into the store about 10:15 p.m., Dayton Lt. John Bardun said.

The robbers jumped the customer service counter and had started to rob the cashier when the officer spotted them, Bardun said.

The robber who escaped pointed his gun at the officer, but did not discharge the weapon, Bardun said. That’s when the officer, whose name was not released, fired a shot that missed.

The robber who pointed his weapon ran from the store. His accomplice was arrested in the customer service area and taken to the Montgomery County Jail, Bardun said.

Moses Matthew Stevens, 45, is being held on charges of aggravated robbery and having a weapon on disability in connection with the robbery, according to online Montgomery County jail records. He is scheduled for a court appearance Friday afternoon.

A police dispatch supervisor said the second participant in the robbery remained at large Friday morning

He was described as a white male in his late 30s or early 40s who is believed to be on parole for a robbery conviction, Bardun said.

Police, using a K-9 unit, searched the area north of the store but did not locate the other suspect.

The store was supposed to close at midnight. It was not immediately clear how many patrons or workers were in the store or the parking lot when the incident occurred. The workers were told not to comment to reporters about the incident.
