Yellow Springs businessman indicted by IRS

DAYTON -- Richard Albrecht Jr., 52, of Yellow Springs, has been indicted on one federal IRS corruption count and 10 counts of failure to pay employment taxes in connection with his former Springfield businesses Automotive Component Systems L.L.C and R&J Rigging/RCSI Inc.

Albrecht appeared in court Friday, July 31, and was released on bond, according to IRS officials.

The indictment alleges that between July 2003 and January 2006, Albrecht failed to turn over about $220,000 in payroll taxes withheld from Automotive Component Systems employees’ paychecks.

Albrecht is also accused of falsifying sales of property in Enon and Springfield in 2000 and 2003 in an effort to impede the IRS, claiming the parcels had been sold while he leased the Enon property to a small business owner for $3,400 per month.

Other allegations of impeding the IRS include Albrecht paying his employees with official cashier’s checks drawn on a company that did not exist, and providing the IRS with fraudulent documents.

IRS officials said willful failure to pay employment taxes carries a maximum punishment of five years imprisonment and a fine of up to $100,000. The corruption count carries a maximum punishment of three years imprisonment and a fine of up to $5,000.

Employers who fail to remit withheld employment taxes to the IRS are not only enriching themselves, they are creating financial problems for their employees, said Jose A. Gonzalez, acting special agent in charge for IRS Criminal Investigation.
