UPDATE:
U.S. Marshals today arrested the 25-year-old man suspected of hitting and killing a 12-year-old boy Saturday. Antwonne McGinnis was arrested at his grandmother’s home about 11:15 a.m. Tuesday, June 16, Marshals spokesman William Taylor said.
“He was not arrested for the fatal accident, but for warrants of probation violations,” Taylor said.

DAYTON — The great-aunt of DaQuan “Day-Day” Sales wants the driver who struck and killed the 12-year-old Dayton boy off the street.
“He needs to be removed from the street now, because he took our baby,” said Shirletta Freeman on Monday, June 15. “Somebody else’s child is going to get hurt if we don’t get this guy.”
An unlicensed driver struck and killed DaQuan on Saturday as he rode his bicycle on Elmhurst Road.
DaQuan died from significant trauma to the head, spine and neck, according to the Montgomery County Coroner’s Office. He was not wearing a helmet.
Police said the driver, a 25-year-old Dayton man, left the scene before returning. Police said he smelled of marijuana and admitted not having a driver’s license.
Court records show he also has several convictions, including carrying concealed weapons and attempted grand theft.
He has not been charged in Saturday’s incident.
“From our standpoint, it has been ruled an accidental death, but that has little bearing on what the (county) prosecutor’s office intends to do,” Coroner James Davis said.
Police are considering DaQuan’s death a vehicular homicide, according to the police report.
The driver has not been arrested, as detectives need time to reconstruct the crash scene, check the vehicle and review medical test results, Lt. Larry Faulkner said Monday.
The driver was given a blood test to determine if he was under the influence of drugs or alcohol at the time of the accident, Faulkner said.
“We need to wait on those results,” he said. “It’s going to take us some time to wrap up the investigation.”
