DAYTON — No charges have been filed against a mother and her boyfriend in the death of her 2-year-old son, and the Montgomery County Prosecutor’s Office has asked Dayton police to continue investigating the homicide.
Dayton detectives met with the prosecutor’s office Thursday, June 11, to seek the charges against Denise S. Stinson, 23, and Mark A. Newberry, 45, said Greg Flannagan, a prosecutor’s office spokesperson. Because of the decision, Newberry and Stinson will be released from the Montgomery County Jail, said Dayton police Lt. Patrick Welsh.
“Investigating detectives and prosecutors reviewed the facts and circumstances and evidence available at this time,” the prosecutor’s office said in a statement. “This is a pending and ongoing investigation, and the team of investigators and prosecutors will continue to evaluate and review evidence as it is found. No decision on charges has been made at this time.”
Stinson and Newberry were arrested early Wednesday morning, about 6 1/2 hours after police responded to 910 Crestmore Ave. Police were dispatched to the home at about 7:55 p.m. Tuesday on the report of a child, later identified as 2-year-old Malechi Dechawn Wilson, having difficulty breathing.
Wilson was pronounced dead at the hospital at 8:46 p.m. at Children’s Medical Center. Stinson and Newberry, who is not the child’s biological father, were taken downtown to police headquarters for questioning and arrested at 2:15 a.m. Wednesday.
Wilson’s death was ruled a homicide by the Montgomery County Coroner’s Office on Wednesday, and medical evidence shows the toddler was in pain for an extended period of time, police said.
The coroner’s office ruled that the death was caused by blunt-force abdominal trauma.
