Rezoning, dividing of Miami County land upsets nearby landowners

Neighbors say they plan to challenge the decision OKing sizes smaller than others in area.

TROY — Several southern Monroe Twp. residents say they will challenge the Miami County commissioners’ decision to allow the creation of 3.9-acre and 2.9-acre residential lots off Ginghamsburg Frederick Road.

Four property owners near the land between Martindale and Bard roads asked commissions Thursday, Oct. 29, to deny the rezoning of the two lots requested by property owner Richard Oaks of Vandalia.

The neighbors said allowing lots of less than five acres would harm the area’s character and property values. In more than 20 years, no lots of less than five acres have been created in the area, they said.

Speaking against the rezoning were Ron Potter, who lives across the road, and Mike Petro, Rick Guenther and Mark Klepacz.

The county planning commission voted unanimously to recommend approval while the zoning commission, after three meetings to discuss the proposal, voted unanimously to recommend denial.

The commission voted 3-0 to approve the rezoning of the two lots from agricultural to residential.

They pointed to property owners’ rights, said five-acre lots are not always the best use of rural property and concluded that they saw no reason to deny the request.

Opponents have 30 days to file referendum petitions seeking to nullify the commissioners’ action.

There's a reason we have zoning. We don't want factories built next to houses, or hog farms next to houses, etc. To change the rules on property after someone has purchased their property changes the value of all properties around. It has nothing to do with "visual ownership". Zoning provides valuable protection and regulation.

I agree -- minus the invective -- with R U Kidding Me, with the idea too many people believe their own ownership of land gives them the right to control others.

Thats right - the four complaning parties already
have their home and tract in the country and they'll be damned if anyone else is going to get
theirs. Its not about the size of the new tracts its about the fact that the new parcels are directly across the road from these clowns
and they don't want to loose their visual ownership of someone elses land. Hey clowns
