Huber Heights attorney Gerald McDonald said unlike other communities the city is taking proactive measures for legal use of marijuana.
Many communities in Montgomery County have called for moratoriums on medical marijuana use and cultivation.

“Other communities, and I’m not aware of any around here for sure other than Huber Heights, said we do want to have the use and so Huber Heights is trying to set forth what the parameters is for this use,” McDonald said.
McDonald took questions from members of the planning commission Tuesday night and discussed cultivators, processors and dispensaries.
“The issues were really location where this use can be permitted distance requirements,” McDonald said.

Commission members expressed concerns about some of the facilities mentioned for use and their location near public schools and parks. Members said they hope to keep the businesses at least 1000 feet away from public areas.
The ordinance will head to city council where it will be discussed at public meetings before council members vote on the issue.
