Man shot in leg won’t cooperate with detectives, police say

A Middletown man was shot Thursday night apparently outside a Sutphin Street residence, but police have little more information about the incident because they say the victim will not cooperate.

Officers were called to 104 Sutphin St. on a report of a shot fired at about 6:20 p.m. Residents reported hearing a gunshot, and a man walking his dog said he saw two men arguing.

The witness said he saw a car pull up and a man in the passenger side arguing with a man wearing a ski mask. A shot was fired and and the man who was shot started jumping around and yelling, according to a police report.

A single round was found by police, but no gunshot victim.

About 10 minutes later, Carrion Payne, 25, was located at Atrium Medical Center with a gunshot wound to the shin area.

Lt. Jim Cunningham said Payne has refused to cooperate with detectives, but they are still investigating the crime as a felonious assault.
