4th man indicted in 2010 fatal home invasion

DAYTON —

A fourth man has been indicted in a fatal home invasion in 2010 for which three other men are serving long prison sentences.

Billy Jack Johnson, Jr., 30, of Middletown, was indicted on nine felony counts, including two involving complicity to commit murder, four of complicity to commit aggravated burglary, two of complicity to commit aggravated robbery and one of being a felon in possession of a firearm.

All counts concern the Dec. 9, 2010, home invasion in Jefferson Twp., which claimed the life of Patrick Hall.

Co-defendants Trammel Dashawn Garrett, 20; Demond Rayshawn Johnigan Jr., 20; and Roderick Trayvone Montgomery, 29, kicked in the front door of a home looking for drugs and money.

Once inside, they grabbed a 9‐year‐old boy and forced him at gunpoint into the master bedroom near the bathroom where victim, Hall, was hiding, according to Prosecutor Mathias H. Heck Jr.

The three threatened to shoot and kill the child unless Hall provided them with drugs and/or money. They also grabbed an adult female who was in the home and forced her to turn off the burglar alarm.

During the course of the home invasion, the assailants shot and killed Hall. Defendant Johnson stayed outside the home in the getaway car.

Previously, the three other co‐defendants were convicted and sentenced for their actions: Johnigan and Garrett to 30 years to life, and Montgomery to 31 years to life.

Johnson is to be arraigned on Dec. 13.
