Dayton man indicted for traffic death of Fairborn man

A Dayton man has been indicted on nine counts for causing the death of a Fairborn man July 16 during a multi-vehicle crash at the southbound Ohio 725 exit off of Interstate 75.

The Montgomery County Prosecutor’s Office announced Wednesday that Joseph C. McGraw, 26, has been indicted on two counts of aggravated vehicular assault, two counts of aggravated vehicular homicide, two counts of vehicular assault, two counts of drunk-driving and one count of failure to stop after an accident. The crash killed Robert J. Halsall, 68, who died in surgery. The incident sent five people to area hospitals.

McGraw, who was not in police custody Wednesday afternoon, is scheduled to be arraigned Jan. 24.

“This defendant made the bad decision to drink and drive and consume drugs, tragically causing the death of an innocent motorist,” Montgomery County Prosecutor Mat Heck said. “Drugs, alcohol and driving do not mix.”

Officials said at about 4:30 p.m. July 16, McGraw was driving southbound on Interstate 75 and took exit 44 for Miamisburg-Centerville Road. As he was exiting, he caused a crash involving four other vehicles.

Halsall, the driver of the first car hit, died at Kettering Hospital while in surgery, according to the Montgomery County Coroner’s Office.

Halsall and his wife Judy had to be extricated from the wreckage of their vehicle.
