DAYTON —
A man convicted of murder in the shooting of another man, a concealed carry permit holder, will be sentenced Jan. 9.
Dwayne Lemont Ellison, 35, of Dayton, has been in the Montgomery County Jail since his arrest March 8.
His trial, before Common Pleas Judge Barbara P. Gorman, started Dec. 14 and ended Thursday. Ellison was also convicted of felonious assault and being a felon in possession of a weapon.
The charges stem from the May 9, 2011, death of Isaiah West, following a shooting outside of Gina’s Party Store II, 2227 Germantown.
West, 21, of Trotwood, was a valid concealed-carry holder. He also had a gun and returned fire at Ellison, who was not struck, according to county Prosecutor Mathias H. Heck Jr.
