Man indicted in crash that killed boy, 7

DAYTON —

A driver who caused a crash that killed a 7-year-old boy in April has been indicted on a felony charge of negligent vehicular homicide.

According to Montgomery County Prosecutor Mathias Heck Jr., 23-year-old-Jessie Combs was making a left turn from Riverside Drive to Ridge Avenue on April 18, 2012, when he turned in front of an oncoming pickup truck.

The truck hit Combs’ vehicle on the rear passenger side. Combs’ girlfriend’s son, Derek Whitaker, was sitting in the back seat improperly restrained. The boy was killed.

Combs did not have a valid driver’s license, according to the prosecutor’s office.

Heck said, “This defendant not only was driving when he shouldn’t have been, but he had this young boy in the car without being properly buckled in or in any type of a booster seat. This little boy lost his life because of the poor judgment of this

defendant and his total lack of consideration for this child.”

Combs is to be arraigned Jan. 24. If convicted, he could face a mandatory six to 18 months in prison and the suspension of his driver’s license for one to five years.
