DAYTON —

The death of 30-year-old Bradlee Thompson inside a house on Hulbert Street early New Year’s Day has been ruled a justifiable homicide, according to an updated police report on the incident.

The decision not to pursue criminal charges in the case was made yesterday when detectives met with prosecutors, according to Greg Flannagan, spokesman for Montgomery County Prosecutor Mat Heck Jr.’s office.

He said the shooting was considered self-defense under the castle doctrine.

Thompson was found shot to death inside 613 Hulbert St. on Jan. 1 after neighbors reported hearing shots at about 3 a.m. Police questioned several individuals the next day, including 18-year-old Tyler Mentel, who stayed at that address according to neighbors.

Mentel was arrested on Jan. 3 on a probation violation and named a person of interest in the case.

Although he is not being charged with Thompson’s death, Mentel remains in the Montgomery County Jail awaiting a revocation hearing on the probation violation.

According to court records, Mentel is on probation after a June arrest for improperly handling of a firearm in a motor vehicle. He was given intervention in lieu of conviction in December.

The conditions of his probation include that he not possess a firearm, that he undergo treatment at the DayMont Behavioral Health Care Center, that he work towards obtaining a GED, abstain from use of drugs and alcohol and pay all court costs and fees, among other conditions, according to court records.

Flannagan said that since the violation was predicated on the homicide, that revocation may also be dropped by the court.
