Second person indicted in May slaying

DAYTON —

A man injured by gunfire during the May 21 slaying of another man on Genesee Avenue has become the second person indicted in that death.

A Montgomery County grand jury indicted Mitchell D. Gray Jr. on several felony charges Monday, including three counts of murder, two counts of felonious assault, two counts of aggravated robbery and two counts of aggravated burglary.

All of the charges concern the death of Robert D. Munday, 34, who was shot and killed around 1 a.m. at the rear of 4421 Genesee Ave. Neighbors notified police after they heard yelling at the residence, followed by gunshots.

Gray was briefly treated at an area hospital before he was transported to the Montgomery County Jail, where he was booked in on unrelated warrants several hours after Munday’s shooting. Gray has remained in the jail ever since, according to records.

Linda Rocia Kay, 23, was indicted on the same charges June 22, as well as a count of tampering with evidence.

Police said in May that Munday died as the probable result of a robbery attempt.

Family members said Munday had three children ranging in age from 10 to 13 years old, and had just returned his children to their mother after having them for the weekend.
