Documents: Sixth person in car night of fatal shooting, robbery

Five suspects in the November shooting death of a 19-year-old Fairfield man will be back in court later this month, but court documents uncovered by the JournalNews indicate there was a sixth person in the car the night a plan was hatched to rob Slaven at his Judy Drive residence.

On Nov. 26, the same day Slaven’s death was ruled a homicide following an autopsy, Nicholas Lovell went to the Fairfield Police Department to provide specific details of the incident, according to an affidavit for a search warrant signed by Detective Rebecca Ervin.

Lovell said he heard Misty D. Williams, Jerry J. Eacholes, Joseph V. Goodin, Christia L. Frymire and a person known as “Junior” — who was later identified as Anthony D. Givens — “creating a plan to rob Mr. Slaven,” according to the court documents.

According to Lovell, Williams texted Slaven to purchase drugs, setting up the robbery. The affidavit indicates an analysis of Slaven’s phone by detectives confirms text messages between the two referencing the drug transaction.

“Mr. Lovell stated that he and five other individuals drove to Mr. Slaven’s residence, the four entered the residence, and when returning to the vehicle they told him that Mr. Slaven had been shot during the robbery,” according to the affidavit.

Butler County Prosecutor Mike Gmoser said he could not comment on a pending case. Fairfield police also declined comment.

Bond for Goodin, whom Gmoser identified as the shooter in Slaven’s homicide, was set by Butler County Common Pleas Judge Patricia Oney at $1 million. Gmoser had requested that the judge set $1 million bonds for all of the accused.

The judge set bail for Eacholes, 26, of Middletown a former Baltimore Street Gang member, and Givens, who police believe is the brother of another member of the same gang, at $500,000 each. Bond was set at $200,000 for both Williams and Frymire, both 19, of Fairfield.

All five are scheduled to appear in Oney’s courtroom Jan. 14 for a pretrial hearing. They face murder, aggravated burglary and robbery with gun specifications charges.
