Suspect in Kettering kidnapping, assault cleared of crime

KETTERING —

A man arrested last week on suspicion of assaulting and abducting a woman from a Kettering parking lot has been cleared of the crime, police said today.

Joseph M. Budz, 49, who was arrested on potential charges of kidnapping, gross sexual imposition and felony theft last week, has been cleared in the case due to DNA evidence, Kettering police said.

Budz was arrested after he was observed jaywalking on East Dorothy Lane and believed to match the description of the suspect from the assault.

The arrest stemmed from an incident on Jan. 26. A female was sitting inside her car in the Big Lots parking lot at 2800 Wilmington Pike when a male entered the car and assaulted her.

The man then took control of the victim’s car and drove it east into an apartment complex on Bobbie Place. He then got out of the car and fled on foot toward East Dorothy Lane.
