Auditor Mary Taylor calls for dismissal of Jones-Kelley

State Auditor Mary Taylor, the top-ranking nonjudicial Republican in Ohio, has called for Democratic Gov. Ted Strickland to fire or ask for the resignation of Helen Jones-Kelley, the embattled director of the Department of Job and Family Services.

Taylor on Thursday, Nov. 20, joined two other top Republicans - House Speaker Jon Husted, R-Kettering, and Senate President Bill Harris - in calling for Strickland to dismiss Jones-Kelley, 57, of Clayton.

Strickland suspended Jones-Kelley for a month without pay on Thursday after a State Inspector General’s report found that she improperly authorized searches on state databases on Samuel Joseph - “Joe the Plumber” - Wurzelbacher - and also improperly used her state e-mail account for political purposes.

“We need to restore accountability and transparency in government and send a message to Ohioans that the misuse and abuse of personal information will not be tolerated,” Taylor said in a press release. “Government leaders need to be responsible for the actions of their employees…”

Dunno Barry - I think Larry raises an interesting point. If Helen Jones Kelly’s snooping on JTP is a firing offense, why not hold the Bush Adminstration and the DoHS to the same standard on warrentless phone tapping?

John is right- she is bullet proof, being a black female. I’m no fan of Gov. Strickland, but he’s kind of between a rock and a hard place here. Her actions alone, and her pathetic attempt to explain them show she has no honor, so a respectable resignation won’t happen either. Hopefully, the states admission that her actions were wrong will leave the door open for Joe to sue her and win. Besides, Strtickland is up for re election in 2 years- Republicans will be happy to do the Obama - call every Democrat Marc Dann, Jones-Kelley, and Jennifer Brunner! (Hey, if you can call McCain GWB, why not???!) There’s a reason Democrats never hold control of this state for long- they manage to screw up every chance they get.

I am sooo tired of the political party blame game. It should not matter if she is (D)= Douchebag or a (R)= Turd, or if she is white or black. SHE SHOULD BE FIRED!!!!! I personally work with sensitive information and I would be removed in a second if I disclosed any information or tried to use my work to set up donations. For all you that are upset if she does not get removed, remember it when we have to vote again. Politicians will need us to be elected and this could make them straighten up.

I am a county employee in an agency that falls under the authority of ODJFS. It is very clear that all employees of our agency must keep information about the people we serve under strictest confidence. We all got the memo about not using agency time or equipment for political purposes. At our agency, we were also told not to try persuade others toward one candidate or another during work hours. That was not strictly enforced. I could have complained when some of my Republican co-workers sent me e-mails about how great McCain and Palin are and how bad Obama is. I just canvassed for Obama on my own time made calls for Obama on my own time from my own phone and smiled quietly after 11/4 when they cried, “How could this have happened?” So whatever would have been done to my co-workers if I had turned them in or if an employee violated confidentiality (which Jones-Kelly must have done since the information was out there) should happen to Jones-Kelly. Fire her.

I am a state employee. I work for the Ohio Department of Job & Family Services. We received several e-mails during the campaign reminding us that the use of state equipment (computer, fax, copier, phone), supplies & work time was not permitted. It was clear that anyone caught violating this policy would be subject to severe disciplinary action including terminaton of employment. All involved should be fired immediately!!!!!

Dear Daytonite, Have you ever entered into the buildings for MCDJFS? Ever worked there? Know anyone who has worked there? There are quite a few reasons as to why the so-called same positions are posted: 1. It’s not a job for just anyone. It’s hard work, often quite stressful. You have numerous customers making constant demands of every worker numerous times throughout every single day. If some do quit, perhaps it’s not the right job for them. It’s not for everyone. 2.Oftentimes, workers move to new positions within the agency. Many workers either move up in position or move to different areas within the agency. 3. They don’t hire just anyone. Some people work out. Some do not. Also, they may not get the right applicants from each posting and so they’ll likely re-post. 4. There a number of areas to work within the agency and a multitude of positions within each area. Just because it’s the same position posted does not mean it’s the same position available. Try again with some actual logic if you’re going to play the blame game.

Here’s my thought. Somethings are public record, others are not. When you have a job with access to things that are not public record, you know that you can not give out this information without authorization in writing of the parties it involves. As a Director it is not only your job to know this, but your job to insure that all of your staff members also follow the law on this. Yes Law, you can be held liable by law for this. She not only knowingly broke that law, she then tried to say it was a common practice to do. Everyone needs to be accountable for their actions, what party you vote for, what race or nationality or religion, that’s not the issue. The issue is doing your job. Also, from my point of view, if you’ve tried to apply for help from her agency or watched the job postings for MCDJFS you can see that they are not a very well run agency at this point. People having to wait 6 hours or more to apply is one example, but also the fact that the same job postings are posted repeatedly show that they can not keep staff. Any government agency that is well run is not going to have these problems.

Squirrellygirl - I don’t know that EVERYBODY thought JT Plumber was a “stellar citizen”. According to Lucas county, he’s been involved in one divorce and a seperate dissolution, and in both cases domestic violenece were cited. So at least Kim and Jennifer Wurzelbacher may beg to differ with you. Evidently, in addition to not paying his taxes ($1,100 to the State of Ohio - and no, according to court records he’s not yet current) he doesn’t pay his hospital bills either - he owes $1,200 there. And, incidentally, if you want to know why YOUR health care costs so much - it’s because your premiums pay for jokers like this. These four facts are available to anybody from the clerk of courts in Lucas county. That is not information that was compromised by the state. Additionally, Joe has self-confessed to other violations of the law related to his work status (not having a license, but working jobs within Toledo city limits where a license was required). What does all this make Joe? A pillar of virtue? Stellar citizen? I’d suggest not. He sounds pretty ordinary to me, and if anything he sounds like he thinks maybe the rules don’t apply to him so much. Up to this point, I don’t have a particular problem with him or his narrative, though. I mean, it’s not his fault the McCain campaign chose to centerpiece him before they knew all the facts. That’s just blind faith on his part as well as the Republican campaign. But where blind faith goes to bad faith is when people like you want to turn Joe into a victim of privacy violations. We’re talking about a guy who went and hired a PUBLICIST before any of the “backgrounding” stuff happened. He has also shared in interviews that twice he has been welfare recipient (which is not a crime - and God bless him if his circumstance was that bad), and in the same interview wants to complain about “the government penalizing his success”. This is the highest order of hypocrisy. Please - just stick to the facts. The guy had data in a state database. The Ohio Department of Family Services went and accessed those records without his permission. It is up to a grand jury to decide if this is an indictable offense. But stop making Joe out to be some kind of hero (unless you are his publicist trying to get him a book publishing deal) - because he’s actually not terribly heroic.

By the way, does anybody else here suspect that Sen. Husted is anxiously awaiting Rep. Shannon Jones to finish her bill legislating against this kind of background checking? I’ll bet he hopes that sucker gets written quick and passed before some shmoe checks the DP&L records from his Kettering “residence” and discovers that the Kw/hour use suggests that nobody has lived there for a while, or a SBC database search shows no outgoing calls from that residence for a year, or Montgomery County Sanitary shows that six months of water use at his “residence” wouldn’t keep a gerbil alive for a week! Boy howdy - sure hope that doesn’t happen!

This act of violating an Ohioans privacy should appall all Ohioans regardless of party. Our politicians work for all Ohioans regardless of party. This must STOP now. We are not the peons to government officials, they supposedly work for us the people of Ohio. This woman violated an Ohioans privacy and gave it to the media to discredit him. Alright, squirrellygirl, then fair is fair. Should a lawyer know better than to call up a large corporate constituent and ask for the use of their private jet to fly to a college football bowl game? A lawyer who was Speaker of the Ohio House? How about using campaign donations to pay for a membership at the Ashland Country Club? Would you have enough discretion not to do that if you were President of the Ohio Senate? The obvious hypocrisy here is that two of the signatories to the call for the dismisal of Jones-Kelly have demonstrated serious ethical lapses of their own. And we won’t even talk about the cease and desist order Auditor Taylor got during her election campaign (for push polling) against Barbara Sykes. Listen to me - if laws were violated, charges will be brought. If Ms. Jones-Kelly is found to have violated a law, then Ms. Jones-Kelly will certainly pay the due penalties, at least with her job and maybe worse. And that is as it should be. But please spare me the “pillar of virtue” posturing by those who are “demanding accountability”. There are plenty of abuses of privilege and power amongst those who are deamding harsher penalties in this particular circumstance.

The plumber who asked a simple question was perceived as a stellar citizen until Jones and her associates starting compromising his privacy. Then the McCain campaign had to concentrate on keeping the public informed since the left wing news media was swaying to the left and didn’t want to report that those taxes that he owed that shouldn’t have been anybody else’s business but Joe’s, and IRS hadn’t even sent him a bill yet. So you don’t think that effected the election? Most of the people with brains saw through it, but there were people out there that though McCain had bad judgement in publicizing Joe the Plumber, so yeah I think it effected the election that Ms. Jones thought it was okay to use the government files as her own private stash. And no, it isn’t mean to call people out when they are screwing with our privacy, especially WHEN IT IS AGAINST THE LAW, remember the privacy act?

Bob - Thanks for the post, and again - I don’t necessarily disagree. I just don’t know what else the Secretary could have done as far as poll integrity. I felt kind of bad for some of the Diebold guys (I know more than a few of them) - I think they might have bought a box of rocks when they picked up Premier Election Systems. They kind of got caught up in a problem I don’t think they could have foreseen. I think you’re right about poll training - but I can’t blame poll workers for that. I think that’s another reason you devolve to paper ballots - it requires the least amount of training I’d guess.

I am a democrat. I voted for Strickland and Obama. I have worked for Helen Jones-Kelley. I have no personal animus against her; however, it is important to note that she would have fired anyone under her employ for having done the very same thing that she did. She is an attorney and she knew better. She is also “double dipping” (collecting a PERS retirement while getting paid for new service under PERS). Her actions have been an embarrassment to the State. Strickland may have erred by not firing her, but a respectable person would have already quit.

In reading these comments, I’m amazed at the vitriol expressed by so many people that probably don’t know Helen and/or exactly what her actions were. We only know what was reported in the media. The Governor has made his decision, Helen has accepted it. If she made an error in judgment, she’s certainly paying for it. I’m a Republican - I didn’t vote for Obama or for Strickland. From where I sit, I don’t think Helen’s actions “stole the election” for Obama nor do I think any error made by a public official rises to the level of a high crime. It amazes me to see the venom expressed here and the lack of forgiveness. We, as a society, often complain that we get lousy public officials but when we get someone that is both intelligent and experienced, we cry “off with her head” at the first sign of a mistake. I can’t imagine why anyone would want to be a public servant knowing there are so many people waiting in the weeds not only hoping for failure but wanting jail time for any mistakes made. We need to turn down the volume on the hatred and let the established procedures address the issue.

Rob: Other counties in Ohio have used, and are still using the touchscreen system without problems. As a life-long resident of Cuyahoga County, I am well aware of the alleged issues with this system. What I saw as the major problems were a lack of training for the poll workers in how to use the system and horrible security related to the data disks that store the machine’s voting records. I don’t know of anyone here who had problems actually using this system to vote. I don’t believe the problem was the Diebold system or it’s design, but the Cuyahoga County Board of Elections itself.

Brunner was probably dragged into this cause she did not do her job either. She did not and has not ensured the integrity of the voting process. They know for a fact one dead person voted this year and possibly 27 more. This is not the first year this has happened. Squirrelygirl - Here’s the thing, then. Ms. Jones-Kelly isn’t guilty of a felony because you say she is. She is after she is charged, indicted, and found by a court to be guilty. Outside of that, then we’re talking about judgement and job performance. Her boss deemed her performance in this instance to be substandard and judgement poor enough - to the point of a month furlough without pay.

Brunner sucks. I’ve never seen Democrats stick together like this before, but it looks like they don’t seem to care if it is underhanded or not. Just an observation, but I’ve seen way too much cheating in this past election, and no, the results are not trusted at least by me. I have my own brain and this is my own conclusion. You come to your own. Obama redefined the word “lying” just like Clinton redefined the words “is” and “sex”.

Wo cares what an auditor thinks? That’s immaterial to this incident. The question is, what does the attorney general think? At least they’re docking her pay instead of the usual “paid administrative leave” which is basically a vacation. Let us know when she’s charged with a crime. How many months does this take??

This is more than just bad judgement. What she did effected the presidential election. I’m not a lawyer, but I just know that she broke more than 1 law here. And she should not be trusted with our private government records again—ever! If it was me, I would have been fired on the spot, no job to go back to, and I’ll bet you everything I have in my purse that I’d be in jail right now, too. She is being given preferential treatment, and this is what causes people to be prejudice when they see unfair treatment and preferential treatment on government jobs, etc. It’s only going to get worse when Obama comes into office. Bush was not perfect, but we WILL look back and wish for the good ol’ Bush days. Stock Market doesn’t seem to like the prospects of this new president who cheated to get his office.

Bob - I hear you, but be fair. The problems with Cuyahoga county’s touch screen systems are well documented (HBO’s “Hacking Democracy” is worth viewing). It’s not as if she willy-nilly decided to use a system that takes longer to count and process for no reason. She kind of had to go with what she knew the county BOEs could verify with minimal challenges. It was that or punch cards.

Rob, I’m not against due process. But I don’t understand how someone who compromised our privacy using government files can be allowed to go back to her job and gain access again to those same records. Aren’t we supposed to be protected here when our privacy rights have been invaded? It sounds to me like Gov Strickland is just going to give her a 1 month suspension and that is considered for him the end of it. If that is true, then I don’t see this “due process” of which you are speaking, sir!

Squirrellygirl - the Constitution is holding for you on line 1, it wants to know why you hate it so much? Everybody take a deep breath - it’s called “due process” (from the Fifth Amendment) and it says “No person shall be … deprived of life, liberty, or property, without due process of law”. If she broke the law, she will be charged. If she is charged, a verdict will be rendered after DUE PROCESS. When that verdict is rendered, justice will be done. That’s how we do it here in the land of the rule of law.

Yes, she definitely broke the law and deserves to be prosecuted and go to prison. Why should she get special treatment just because she is a black female democrat? Joe should sue her and the gov’t. I know he would win, too! I heard he’s already paid those taxes, and that he hadn’t even received a bill for the taxes when it was splattered all over the news like that.

I would be looking into the Govener’s qualifications to run this state if he can’t make the decision to fire her on his own. Nuff said…………….

To “Concerned Person”. Yes, I too am a system administrator. Sucks doesn’t it. But, did she break a law by accessing it? True, here judgement seems to be lacking in her use of said knowledge, but there is always someone who authorizes someone to have said access. They need to step up to the plate and take some of the blame for giving access to someone who apparently does not know how to keep information confidential. Think about it, people in foreign countries have more access to your personal information than many individuals in the US. And you want more outsourcing….This is a prime example of qualified individuals being shut out of a job and someone “given” a job they are unqualifed for ends up with it.

I agree with Ron. Fire her. Fire her now. Prosecute her. Prosecute her now. She needs to be in prison for what she did. Using government email to get a candidate elected is bad enough, but delving into private government records in order to hurt someone and sway a presidential election is a whole other animal here.

Sec of State Brunner is the one that made sure all of the questionable ballots were counted in this year’s election, right? Not sure about what else this Democrat has been up to, but it is probably not good. The only reason Obama got elected to Presidency is because he cheated.

I don’t get the “no harm, no foul” comments. She’s already been fined about $13K. That doesn’t sound like “life just goes on” to me, anyway. If she broke a law, and her terms of employment call for dismissal in the instance of felony convictions, then she’ll be fired. Until then, she serves at the discretion of her employer, who’s put her on leave. There is a thing called due process - we’re all entiltled to it.

If she has access to a system, why should she be fired if she uses it ? The person who authorized her access should be penalized. Humans are naturally curious.

itll business as usual with ted strickland do as little as possible to minumize your chances of doing anything wrong. Ken Blackwell was the better choice but to many people were afraid to vote for him just because of how taft ran this state so poorly, but strickland and taft dont see eye to eye on much

As a double minority (i.e. black female) Jones-Kelly is bullet-proof. Add the fact that the Gov. is a Dem. and the chance of her being fired is zero. A middle-aged, white, Republican, guy would have already been gone. Facts of life.
